2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON, APPROVING
CONTRACT NO. 365, 44th STREET IMPROVEMENT, ALCOA AVENUE TO DOWNEY
3 ROAD, AND HEATER PLANING AT VARIOUS STREET INTERSECTIONS, IN
ACCORDANCE WITH CONTRACT NO. 365 OF THE CITY OF VERNON.

5 THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS:
6 WHEREAS, there has been presented to the City Council
7 of the City of Vernon Contract No. 365 for 44th Street improve-
8 ment (Alcoa Avenue to Downey Road) and heater planing at various
9 street intersections, within the City of Vernon, and
10 WHEREAS, the City Council of the City of Vernon has
11 determined that it is in the best interests of the City that
12 said Contract be awarded in accordance with applicable State
13 laws,
14 NOW, THEREFORE, BE IT RESOLVED:

SECTION 1: That Contract No. 365 is hereby approved
16 by the City Council of the City of Vernon.

SECTION 2: That the City Clerk of the City of Vernon
18 is hereby directed to file in his office in the City Hall of the
19 City of Vernon a copy of Contract No. 365.
20
SECTION 3: That the City Clerk of the City of Vernon
21 is hereby directed to give notice in writing, inviting sealed
22 proposals or bids for 44th Street improvement (Alcoa Avenue to
23 Downey Road) and heater planing at various street intersections,
24 in accordance with Contract No. 365, and in accordance with this
25 resolution.

SECTION 4: There being no newspaper of general circu-
27 lation printed, published, or circulated in the City of Vernon,
28 the City Clerk is hereby directed to post said notice, or cause
29 the same to be posted in three (3) of the most public places in
30 the City of Vernon, to wit: The northwest corner of 38th Street
31 and Santa Fe Avenue, the northeast corner of Leonis Boulevard
32 and Pacific Boulevard, and on the bulletin board in the lobby of

.1 the City Hall of the City of Vernon, located at 4305 Santa Fe
2 Avenue, in said City.

SECTION 5: The City Council of the City of Vernon has
4 ascertained the general prevailing rate of per diem wages and
5 rates for legal holidays and for overtime work in the locality
6 in which the work is to be performed, described in Contract No.
7 365, for each craft or type of workman or mechanic needed to
8 execute the contract which will be awarded to the successful
9 bidder, and that the general prevailing rate of per diem wages
10 and rates for legal holidays and for overtime work in the
11 locality of the execution of said Contract No. 365, for each
12 craft, classification, or type of workman needed is set forth in
13 said Contract and incorporated by reference at this point for all
14 purposes as if set forth in full, and hereby approved by the
15 City Council of the City of Vernon.

SECTION 6: That the City Clerk of the City of Vernon
17 is directed to post said notice forthwith, and the first posting
18 of said notice shall be not less than ten (10) days before the
19 date of opening bids for the proposed work. That said notice
20 shall provide that sealed proposals or bids will be received by
21 the City of Vernon, California, at the office of the City Clerk
22 of said City, at the City Hall, 4305 Santa Fe Avenue, until the
23 hour of two (2) o'clock P.M., on the 2nd day of November, 1971,
24 and in accordance with Contract No. 365 approved by said City.

SECTION 7: That the City Clerk of the City of Vernon
26 shall certify to the passage of this resolution and thereupon
27 and thereafter, the same shall be in full force and effect.
28 ADOPTED and APPROVED this 19th day of October, 1971.

MENT FROM ALCOA AVENUE TO DOWNEY ROAD AND HEATING PIANING AT
3 VARIOUS STREET INTERSECTIONS, IN ACCORDANCE WITH CONTRACT NO.
365 OF THE CITY OF VERNON.

5 Pursuant to Resolution No. 4073 of the City of Vernon,
6 adopted on the 19th day of October, 1971, directing same, notice
7 is hereby given that sealed proposals or bids will be received
8 by the City of. Vernon, California, at the office of the City
9 Clerk of said City, at the City Hall, 4305 Santa Fe Avenue, until
10 the hour of two (2) o'clock P.M., on the 2nd day of November,
11 1971, for the 44th Street Improvement from Alcoa Avenue to Downey
12 Road and HeaterPlaning at Various Street Intersections, in accord-
13 ance with Contract No. 365 approved by said City. The proposals
14 will be publicly opened and read in the Council Chamber of the
15 City Hall located at 4305 Santa Fe Avenue, Vernon, California,
16 on the date and at the time above mentioned. Specifications and
17 Contract Documents may be obtained at the above mentioned office
18 of the City Clerk upon payment of a deposit of ten dollars ($10.00
19 for each specification.
20 The construction to be done and materials to be furnished
21 under said Contract No. 365 are approximately as follows:

Bidders are hereby notified that, pursuant to the
provisions of Sections 1770-1781, inclusive, of the Labor Code
of the State of California, the City Council of the City of
Vernon has ascertained the general prevailing rate of per diem
wages and rates for legal holidays and for overtime work in the
locality in which this work is to be performed, for each craft or
type of worknlan or mechanic needed to execute the contract which

\vi11 be awarded to the successful bidder, and that Resolution
9 No. 4073 , of the City of Vernon establishes said rates, and
10 is on file with the City Clerk of the City of Vernon.
11 Notice is further hereby given that all bidders may
12 submit with their bids a sworn statement of their financial
13 responsibility, technical ability and experience. Such sworn
14 statement may be required before award is made to any particular
15 bidder.
16 To be entitled to consideration, each bid submitted
17 pursuant to this notice shall be made out on a form to be
18 obtained at the Office of the Director of Public Works, shall' be
19 accompanied by a certified check, draft, or bid bond, payable at
20 a bank authorized to do business in the State of California,
21 made payable at sight to the City Clerk of the City of Vernon,
22 in an amount equal to ten per cent (10%) of the bid submitted,
23 shall be delivered to the City Clerk of the City of Vernon in a
24 sealed envelope at, or before, the time stated herein, and must
25 be plainly marked "Proposal for Contract No. 365"
26 The above-mentioned check or bond shall be given as a
27 guarantee that the bidder will enter into a contract if awarded
28 to him and will be declared forfeited if the successful bidder
29 refuses or neglects to enter into a contract of the required form
30 after being requested to do so by the City Clerk of the City of
31 Vernon, California. The successful bidder will be required to

furnish a labor and material bond in an amount equal to fifty

.1 per cent (50%) of the contract price, and a faithful performance
2 bond in an amount equal to one hundred per cent (100%) of the
31 contract price.
4 Unless otherwise required by law, no bidder may with-
5 draw his bid for a period of thirty (30) days after the date set
6 for the opening thereof.
7 A deposit of ten dollars (SlO.OO) will be required to
8 secure the Plans and Specifications, as a guarantee that the
9 Plans and Specifications will be returned, which deposit will be
10 refunded in case same are returned to the City in good condition
11 not later than thirty (30) days after the bids on the ,,york will
12 bave been opened.
13 The City of Vernon reserves the right to reject any and
14 all bids or waive any informality in the bid.
