RESOLUTION NO. 4101
A. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING
CONTRACT NO. 354, 26th STREET IMPROVEMENT, DOWNEY ROAD TO ATLANTIC
BOULEVARD, INDIANA, BONNIE BEACH AND AYERS IMPROVEMENT, 26th STREET
TO BANl).INI BOULEVARD, IN ACCORDANCE WITH CONTRACT NO. 354 OF THE
CITY OF VERNON.
THE CITY COUNCIL OF THE>CITYOF VERNON RESOLVES AS FOLLOWS:
WHEREAS, there"has been presented to the City Council of

WHEREAS, the City Council .of the City of Vernon has deter-
12 mined that it is in the best interests of the City that said Con-
13 tract be awarded in ~eordance with applicable State Laws,

NOW, THEREFORE, BE IT RESOLVED:
Section 1: That Contract No. 354 is hereby approved by
16 the City Council of the City of Vernon.

Section 2: That the City Clerk of the City of Vernon is
18 hereby directed to file in his Office in the City Hall of the City
19 of Vernon, a copy of Contract No. 354.

Section 3: That the City Clerk of the City of Vernon is
21 hereby directed to give notice in writing, inviting sealed proposal
22 or bids, for 26th Street Improvement, Downey Road to Atlantic Boule
23 Vard, Indiana, Bonnie Beach and Ayers Improvement, 26th Street to
24 Bandini Boulevard, in accordance with Contract. No. 354, and in
25 accordance with this reso lution.

Section 4: There being no newspaper of genera1circula-
27 tion printed, published or circulated in the City of Vernon, the
28 City Clerk is hereby directed to post said Notice or cause the same
29 to be posted in three (3) of the most public places in the City of
30 Vernon, to wit: the northeast corner of 38th Street and Santa Fe
31 Avenue, the northeast corner of Leonis Boulevard and Pa~ific Bou1e-
32 vard and on the bulletin board in the lobby of the City Hall of th~

Section 5:
The City Council of the City of Vernon has
:3 ascertained the general prevailing rate of per diem wages and rates
4 for legal holidays and for over-time work in the locality in which
5 the work is to be perfo~ed, described in Contract No. 354., for
6 each craft or type of workman or mechanic needed to execute the
7 Contract which will be awarded to the successful bidder, and that
8 the general prevailing rate of per diem, wages and rates for legal
9 holidays and for over-timework ~n the locality of the execution

10 of said Contract No. 354, fgr ea,?h.craft classification or type of
11 workman is set forth insai9, .contract, and incorporated by referenc
12 at this point for all purposes as if set forth in full, and hereby
13 approved by the City Council of the City of Vernon.

Section 6:
That the City Clerk of the City of Vernon
15 is directed to post said Notice forthwith and the first posting of
16 said Notice shall be not less than ten (10) days before the date
17 of Opening Bids for the proposed work. That said Notice shall pro-
18 vide that Sealed Proposals or Bids will be received by the City of
19 Vernon, California, at the Office of the City Clerk of said City
20 at the City Hall located at 4305 Santa Fe Avenue, Vernon, Califor-
21 nia, until the hour of two o'clock (2:00) p.m., on the 4th day of
22 April, 1972, and in accordance with Contract No. 354 approved by
23 said City.

Section 7:
That the City Clerk of the City of Vernon
25 shall certify to the passage of this Resolution and thereupon and
26 thereafter the same shall be in full force and effect.

MENT, DOWNEY ROAD TO ATLANTIC BOULEVARD, INDIANA, BONNIE BEACH,
AND AYERS IMPROVEMENT, 26th STREET TO BANDINI BOULEVARD, IN ACCOR-
DANCE WITH CONTRACT NO. 354 OF THE CITY OF VERNON.
Pursuant to Resolution No. 4101 of the City of Vernon,
adopted on the 21st day of March, 1972, directing same, notice is
hereby given that sealed proposals or bids will be received by the
City of Vernon, California, at the office of the City Clerk of said
City, at the City Hall,. .4305 Santa Fe Avenue, until the hour of
two (2)o'clockP. M., on the 4th day of April, 1972, for 26th
Street lmprovement, Downey Road to Atlantic Boulevard, Indiana,
Bonnie Beach, and Ayers Improvement, 26th Street to Bandini Bou1e-
13 vard, in accordance with Contract No. 354 approved by said City.
14 The proposals will be publicly opened and read in the Council Cham-
15 bers of the City Hall located at 4305 Santa Fe Avenue, Vernon,
16 California, on the date and at the time above mentioned. Specifi-
17 cations and contract documents may be obtained at the above-men-
18 tioned office of the City Clerk upon payment of a deposit of ten
19 dollars ($10.00) for each specification.

Bidders are hereby notified that, pursuant to the
provisions of Sections 1770-1781, inclusive, of the Labor Code
of the State of California, the City Council of the City of
Vernon has ascertained the general prevailing rate of per diem
wages and rates for legal holidays and for overtime work in the
locality in which this work is to be performed, for each craft or
type of workman or mechanic needed to execute the contract which
,vill be awarded to the successful bidder, and that Resolution
No. 4101, of the City of Vernon establishes said rates, and
is on file with the City Clerk of the City of Vernon.
Notice is further hereby given that all bidders may
submit with their bids a sworn statement of their financial
responsibility, technical ability and experience. Such sworn
statement may be required before award is made to any particular
bidder.
To be entitled to consideration, each bid submitted
pursuant to this notice shall be made out on a form to be
obtained at the Office of the Director of Public Works, shall' be
accompanied by a certified check, draft, or bid bond, payable at
a bank authorized to do business in the State of California,
made payable at sight to the City Clerk of the City of Vernon,
in an amount equal to ten per cent (10%) of the bid submitted,
shall be delivered to the City Clerk of the City of Vernon in a
sealed envelope at, or before, the time stated herein, and must
be plainly marked "Proposal for Contract No. 354 ".
The above-mentioned check or bond shall be given as a
guarantee that the bidder will enter into a contract if awarded
to him and will be declared forfeited if the successful bidder
refuses or neglects to enter into a contract of the required. form
after being requested to do so by the City Clerk of the City of
Vernon, California. The successful bidder will be required to
furnish a labor and material bond in an amount equal to fifty

per cent (50%) of the contract price, and a faithful performance
2 bond in an amount equal to one hundred per cent (100%) of the
3 contract price.

4 Unless otherwise required by law, no bidder may with-
5 draw his bid for a period of thirty (30) days after the date set
6 for the opening thereof.
7 A deposit of ten dollars ($10.00) will be required to
8 secure the Plans and Specifications, as a guarantee that the
9 Plans and SpGcifications will be returned, which deposit will be
10 refunded in case same are returned to the City in good condition
11 not later than thirty (30) days after the bids on the work will
12 bave been opened.
13 The City of Vernon reserves the right to reject any and
14 all bids or v.7aive any infonnality in the bid.
