Pursuant to your instructions of the last regular meeting
of the City Council of the City of Vernon, this is to
advise you that I have had an opportunity to do some
research regarding whether the City may properly install
traffic signs, curb markings, or other devices within the
central manufacturing district on property not owned by the
City of Vernon but which would regulate traffic on privately
owned streets.
At this time, pursuant to Resolution No. 4112, adopted pur-
suant to Vehicle Code 521107.5, certain private streets have
been determined to be subject to the applicable provisions
of the Vehicle Code of the State of California. Similarly,
the Vehicle Code provides that cities may enact ordinances
providing for the control of traffic and, in particular,
Section 3 of Ordinance No. 807 of the City of Vernon (our
Traffic Ordinance) was enacted pursuant to applicable sections
of the Vehicle Code. Since there seems to be no definitive
authority on this subject, it is my opinion that since the
Traffic Ordinance was enacted pursuant to the Vehicle Code,
and Resolution No. 4112 says that the Vehicle Code shall be
enforced on such private roadways, that traffic control devices
could be enforced in the central manufacturing district.
Ordinance No. 807, in Section 12, (V.C.C. 16.13) provides for
the proper procedure for the setting of speed limits, the
placing of official signs or curb markings, and other prohi-
bitive signs and provides that proper notice shall be given

On May l6, 1972, the City Council referred a com-
munication from the A.J. Lynch & Company to the
City Attorney, Director of Public Works and the
Chief of Police for report.
The undersigned has not yet directed officers to
enforce the provisions of the Vehicle Code in the
Central Manufacturing District as authorized by
Resolution No. 4112, because the various paintings
and signs in the Central Manufacturing District
have not yet been officially accepted by the Dir-
ector of Public Works.

Gentlemen:
We have been operating in the City of Vemon since 1956 as a distributor
of Industrial Chemicals & Coatings, Raw Materials, during which time,
under the administration of the Central Manufacturing District, curbs were
painted red in front of each of our warehouse locations to provide side
loading and unloading of large vehicles that could not gain access to our
loading docks. The paint has deteriorated now to the point where new
painting is necessary.
We have been i.nformed that the Police Department of the City of Vernon is
now responsible for enforcement of provisions of the vehicle code in the
private areas of the Central Manufacturing District. If this is correct
then it would seem that the curbs should be painted yellow and marked for
loading and unloading purposes.
It is therefore requested that the appropriate department be instructed
to see to the proper painting and marking of the appropriate areas at each
of our properties to eliminate the encroachment of all-daY" parkers who
have tended to restrict our operation due to failure to obsEirve the present
faded red curb markings.
