"}' . . 1 RESOLUTION NO. 4115 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON ESTABLISHING VACATION POLICIES FOR EMPLOYEES OF THE CITY OF VERNON AND REPEALING 3 ALL RESOLUTIONS IN CONFLICT HEREWITH 4 THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS: 5 WHEREAS, the City Council of the City of Vernon desires 6 to establish policies governing vacations that will be fair and 7 equitable to all City employees, and 8 WHEREAS, the working schedules of various employees of 9 the City Departments are not the same, 10 11 NOW, THEREFORE, BE IT RESOLVED: Section 1: That certain employees of the Police and 12 Water Departments of the City of Vernon, whose duties are such that 13 they do not have or receive the time-off benefits of regular legal 14 holidays, shall be entitled to three calendar weeks vacation during 15 the second year of said service and each year thereafter, at full 16 pay. 17 Section 2: That each employee of the City except those 18 specifically mentioned in Section 1, Section 4 and Section 6 of 19 this Resolution, shall be entitled to ten (10) working days' vaca- 20 tion during the second year of said service and each year thereafter 21 at full pay.. Permanent, full-time employees, except those specifi- 22 cally mentioned in Section 1, Section 4 and Section 6 of this 23 Resolution, who have completed ten (10) years of continuous service, 24 shall be granted fifteen (15) working days' annual vacation leave 25 with pay. (This section shall apply but not be limited to employees 26 of the Police Department, Water Department and Miscellaneous 27 Employees of the Fire Department, as defined by the Public Employees 28 Retirement System of the City .f Vernen, who have or receive the 2'9 time-off benefits of regular legal holidays.) 30 Section 3: That all permanent, full-time employees of 31 the Police and Water Departments of the City of Vernon, whose d~tie 32 are such that they do not receive the benefits of regular legal -1- . . ., .' , .... ... ~. . : 'I' . . 1 holidays, who have completed ten (10) years of continuous service, 2 shall be granted four (4) calendar weeks' annual vacation leave 3 with pay, with a stipulation that employees entitled to four (4) 4 calendar weeks' annual vacation with pay may not fake more than 5 three (3) calendar weeks at anyone time. The only exception to 6 the above policy is that a Department Head may for good reason, 7 in his discretion, authorize an eligible employee to take all foun 8 (4) weeks at the same time. It is the intention of the City Coun- 9 cil that the fourth week granted to eligible employees be taken at 10 some time other than the normal or regular vacation period so that 11 it will be unnecessary to employ additional personnel during vaca- 12 tion periods, and that said fourth week be taken any time during 13 the calendar year that is satisfactory to the Department Head. 14 15 Section 4: SHIFTS (FIRE DEPARTMENT) 4.1 For the period commencing January 1, 1972, and 16 continuing thereafter through the calendar year ending December 31, 17 1976, Fire Department employees engaged in fire suppression shall 18 be annually scheduled to work for One Hundred Twenty-two (122), 19 Twenty-four (24) hour shifts. 20 4.2 Said One Hundred Twenty-two (122) shifts shall con- 21 stitute the gross shifts to be scheduled from which the following 22 shifts shall be deducted annually as, and in lieu of, paid vacation 23 and holidays: 24 4.21 After completion of one (1) year or more 25 years of continuous service, but less than ten (10) years - twelve 26 (12) twenty-four (24) hour shifts. 27 4.22 After ten (10) years or more years of con- 28 tinuous service, two (2) additional twenty-four (24) hour shifts. 29 4.3 The shifts which employees are entitled to deduct 30 pursuant to Subsections 4.21 and 4.22 shall be scheduled as shifts 31 off on a year-around basis, subject to the following provisions: 32 4.31 Each employee must be scheduled for at least -2- .. ," . . " :. ! 1 - ,1 five (5) consecutive shifts off during the anniversary year followin 2 his anniversary date on which he became entitled to deduct the 3 shifts in question. 4 4.32 Each employee must be scheduled for all 5 shifts which he is entitled to deduct as shifts off during the 6 anniversary year immediately following the anniversary date on 7 which he became entitled to deduct such shifts. 8 4.33 Selection of shifts off shall be by rank and 9 according to seniority within rank. 10 4.34 No more than two (2) officers and no more 11 than seven (7) employees, including officers, in ~platoon shall 12 be scheduled off duty at anyone time. 13 4.35 The selection of shifts off shall be made 14 annually for the following calendar year no later than December 31 15 of the immediately preceding calendar year, except that the selec- 16 tion of scheduled shifts off for the calendar year 1972 shall be 17 completed no later than February 1, 1972; 18 4.36 Employees who are entitled to deduct two (2) 19 additional shifts off pursuant to Subsection 4.22 shall have the 20 option to accept pay instead of time off at the rate of 7/30ths 21 of one (1) month's salary for such two (2) shifts, or to be sche- 22 duled off duty for the additional two (2) shifts. This option 23 must be exercised simultaneously with the selection of shifts off 24 duty pursuant to Section 4. 25 Warrants shall be issued during the month of 26 April to all eligible Fire Department personnel who have selected 27 the option to accept pay instead of time off pursuant to this sec- 28 tion. The amount each eligible person shall receive shall be 2'9 based on his monthly salary as of April 1st of the current year. 30 On April 1st of each year, the Fire Chief shall submit to the 31 City Clerk/Director of Finance a certified list of Fire Department 32 personnel who are eligible to receive the extra week's pay as -3- . . . . . , ': . t . 1, authorized by this section. 2 4.37 The procedures and mechanics for the 3 scheduling of shifts off and the selection of scheduled shifts off 4 shall be established by the Chief Engineer in accordance with the 5 provisions of Subsection 4.3. 6 4.4 Any employee who is terminated shall be paid upon 7 his termination for all unused shifts-off to which he became 8 entitled on his immediately preceding anniversary date, at his 9 hourly rate of pay. 10 4.5 Any employee who is permanently transferred out of 11 the fire suppression service during an anniversary year shall be 12 paid for his unused shifts off to which he became entitled on his 13 immediately preceding anniversary date at his hourly rate and shall 14 become eligible for vacation benefits on his next following anni- 15 versary date in accordance with City Ordinances, Resolutions and 16 Policies applicable to the classification in which he works. 17 4.6 Any employee with one (1) or more years of con- 18 tinuous service who is transferred to fire suppression during 19 an anniversary year shall be entitled to a proportionate number 20 of shifts off to be scheduled during the remainder of his current 21 anniversary year, unless he has already received the vacation 22 benefits to Which he became entitled on his immediately preceeding 23 anniversary date in his prior classification. 24 4.7 All permanent Fire Department personnel defined 25 as Safety Members by the Public Employees' Retirement System shall 26 be required to take an annual leave of absence from active duty of 27 not less than fifteen consecutive days in accordance with Califor- 28 nia Government Code ~ 53250. 29 Section 5: That permanent, full-time Miscellaneous 30 Employees (as defined by the Public Employees Retirement System), 31 with the exception of certain employees in the Water Department 32 who presently receive four (4) weeks' vacation after ten (10) -4- - .. . ~ ," . . 1 2 :3 years of continuous service, who have completed fifteen (15) years of continuous service, be granted twenty (20) working days annual vacation leave with pay. It is the intention of the City Council that the five (5) additional working days granted to eligible employees be taken at some time other than the normal or regular vacation period so that it will be unnecessary to employ additional personnel during vacation periods and that the additio- nal five (5) working days be taken any time during the calendar year that is satisfactory to the Department Head. 5.1 That all permanent, full-time employees of the Water Department of the City of Vernon, whose duties are such that they do not receive the benefits of regular legal holidays, who have completed fifteen (15) years or more of continuous service shall be granted 7/30ths of one month's salary based on his monthly salary as of April 1st of the current year. On April 1st of each year, the Director of Public Works shall submit to the City Clerk/ Director of Finance a certified list of Water Department personnel who are eligible to receive the extra week's pay as authorized by 23 this section. Warrants shall be issued to all eligible Water 24 Department personnel during the month of April of each year, com- 25 mencing with April, 1973. 26 Section 6: That all permanent eight-hour personnel 27 of the Fire Department defined as Safety Members by the Public Em- 28 ployees' Retirement System shall be entitled to ten (10) working 2'9 days' Vacation and shall be required to take fifteen (15) consecu- 30 tive days' vacation in accordance with Government Code ~53250 during 31 the second year of said service and each year thereafter at full 32 pay. " ... 0" t. 1 defined as Safety Members bytbe Public Employees' Retirement System, 2 who have completed fifteen (15) years of continuous service, shall 3 be granted twenty (20) working days' annual vacation leave with pay. 4 All conditions as outlined in Section 5, relative to employees 5 entitled totwenty (2) working days' annual vacation leave with pay, 6 shall app ly . 7 Section 7: It is the intention of the City Council that 8 the maximum vacation leave that any employee shall be entitled to i 9 any calendar year shall be four weeks for those employees designate 10 in Section 3 and twenty (20) working days for those employees de- II signated in Sections 5 and 6. 12 Section 8: All vacation periods shall be warranted or 13 approved by the Administrative Head of each Department and shall be 14 taken by said employee or employees at any time during the calendar 15 year that is satisfactory to the Department Head. 16 Section 9: No vacation for any employee of the City of 17 Vernon shall be accumulated from calendar year to calendar year, 18 nor shall the same be compensated for if not utilized during a 19 calendar year. 20 Section 10: All Department Heads are responsible to 21 see that they take a vacation as authorized herein, and the failure 22 to so schedule a vacation, or take the same, without the City Coun- 23 cil's approval, shall be deemed a waiver of the right to take the 24 same or be compensated for the same in any subsequent calendar year 25 Section 11: That Resolution No. 3022 is specifically 26 repealed, and all Resolutions in conflict with this Resolution are 27 hereby repealed. 28 Section 12: That the City Clerk of the City of Vernon 29 is hereby directed to certify to the passa.ge of this Resolution, 30 and thereupon and thereafter the same shall be in full force 31 _______ 32 _______ -6- .
