RESOLUTION NO. 4128
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING
CONTRACT NO. 366, VIOLET ALLEY IMPROVEMENT 27th STREET TO 30th
STREET AND 37th STREET AT SANTA FE AVENUE INTERSECTION IMPROVE-
MENTS, IN ACCORDANCE WITH CONTRACT NO. 366 OF THE CITY OF VERNON
THE CITY COUNCIl OF THE CITY OF VERNON RESOLVES AS FOLLOWS:
WHEREAS, there has been presented to the City Council of
the City of Vernon Contract No. 366 for Violet Alley Improvement
27th Street to 30th Street and 37th Street at Santa Fe Avenue
Intersection Improvements, within the City of Vernon, and
WHEREAS, the City Council of the City of Vernon has deter-
mined that it is in the best interests of the City of Vernon that
said Contract be awarded in accordance with applicable State Laws,
NOW, THEREFORE, BE IT RESOLVED:
SECTION 1: That Contract No. 366 is hereby approved by the
City Council of the City of Vernon.
SECTION 2: That the City Clerk of the City of Vernon is
17 hereby directed to file in his office in the City Hall of the
18 City of Vernon a copy of Contract No. 366.

SECTION 3: That the City Clerk of the City of Vernon is
20 hereby directed to give Notice, in writing, inviting sealed pro-
21 posals or bids for Violet Alley Improvement 27th Street to 30th
22 Street and 37th Street at Santa Fe Avenue Intersection Improve-
23 ments, in accordance with Contract No. 366, and in accordance
24 with this Resolution.

SECTION 4: There being no newspaper of general circulation
26 printed, published or circulated in the City of Vernon, the City
27 Clerk is hereby directed to post said Notice or cause the same to
28 be posted in three (3) of the most public places within the City
2'9 of Vernon, to wit: at the northwest corner of 38th Street and
30 Santa Fe Avenue, the northeast corner of Leonis Boulevard and
31 Pacific Boulevard, and on the bulletin board in the Lobby of the
32 City Hall of the City of Vernon, locatedat 4305 Santa Fe Avenue

in said City.
SECTION 5: The City Council of the City of Vernon has
3 ascertained that the general prevailing rate of per diem wages
4 and rates for legal holidays and over time work in the locality
5 in which the work is to be performed, described in Contract No.
6 366, for each craft or type of workman or mechanic needed to
7 execute the Contract which will be awarded to the successful bid-
8 der, and the general prevailing rate of per diem wages and rates
9 for legal holidays and for over time work in the locality of the
10 execution of Contract No. 366, for each craft, c~assification or
11 type of workman is set forth in said Contract, and incorporated
12 by reference at thbpoint for all purposes as if set forth in
13 full, and hereby approved by the City Council of the City of
14 Vernon.

SECTION 6: That the City Clerk of the City of Vernon is
16 directed to post said Notice forthwith and the first posting of
17 said Notice shall be not less than ten (10) days before the date
18 of Opening Bids for the proposed work. That said Notice shall
19 provide that sealed proposals or bids will be received by the
20 City of Vernon, California, at the Office of the City Clerk of
21 said City, at the City Hall, located at 4305 Santa Fe Avenue,
22 Vernon, California 90058, until the hour of two (2) o'clock P.M.,
23 on the 8th day of November, 1972, and in accordance with Contract
24 No. 366 approved by said City.

SECTION 7: That the City Clerk of the City of Vernon shall
26 certify to the passage of this Resolution and thereupon and there-
27 after the same shall be in full force and effect.

5 Pursuant to Resolution No. 4128 of the City of Vernon,
6 adopted on the 17th day of October, 1972, directing same, notice
7 is hereby given that sealed proposals or bids will be received by
8 the City of Vernon, California, at the office of the City Clerk of
9 said City, at the City Hall, 4305 Santa Fe Avenue, until the hour
10 of two (2) o'clock P.M., on the 8th day of November, 1972, for
11 Violet Alley Improvement, 27th Street to 30th Street and 37th
12 Street and Santa Fe Avenue Intersection Improvement, in accordance
13 with Contract No. 366, approved by said City. The proposals will
14 be publicly opened and read in the Council Chambers of the City
15 Hall located at 4305 Santa Fe Avenue, Vernon, California, on the
16 date and at the time above mentioned. Specifications and contract
17 documents may be obtained at the above mentioned office of the
18 City Clerk upon payment of a deposit of ten dollars ($10.00) for
19 each specification.

Bidders are hereby notified that, pursuant to the
provisions of Sections 1770-1781, inclusive, of the Labor Code
of the State of California, the City Council of the City of
Vernon has ascertained the general prevailing rate of per diem
wages and rates for legal holidays and for overtime work in the
locality in which this work is to be performed, for each craft or
type of workman or mechanic needed to execute the contract which

\vill be awarded to the successful bidder, and that Resolution
9 No. 4128 , of the City of Vernon establishes said rates, and
10 is on file with the City Clerk of the City of Vernon.
11 Notice is further hereby given that all bidders may
12 submit with their bids a sworn statement of their financial
13 responsibility, technical ability and experience. Such sworn
14 statement may be required before award is made to any particular
15 bidder.
16 To be entitled to consideration, each bid submitted
17 pursuant to this notice shall be made out on a form to be
18 obtained at the Office of the Director of Public Works, shall' be
19 accompanied by a certified check, draft, or bid bond, payable at
20 a bank authorized to do business in the State of California,
21 made payable at sight to the City Clerk of the City of Vernon,
22 in an amount equal to ten per cent (10%) of the bid submitted,
23 shall be delivered to the City Clerk of the City of Vernon in a
24 sealed envelope at, or before, the time stated herein, and must
25 be plainly marked "Proposal for Contract No. 366"
26 The above-mentioned check or bond shall be given as a
27 guarantee that the bidder will enter into a contract if awarded
28 to him and will be declared forfeited if the successful bidder
29 refuses or neglects to enter into a contract of the required- form
30 after being requested to do so by the City Clerk of the City of
31 Vernon, California. The successful bidder will be required to
32
furnish a labor and material bond in an amount equal to fifty

per cent (50%) of the contract price, and a faithful performance
bond in an amount equal to one hundred per cent (100%) of the

contract price.
Unless otherwise required by law, no bidder may with-
draw his bid for a period of thirty (30) days after the date set .
for the opening thereof.
A deposit of ten dollars ($10.00) will be required to
secure the Plans and Specifications, as a guarantee that the
Plans and Specifications will be returned, which deposit will be
refunded in case same are returned tc the City in good conditicn
not later than thirty (30) days after the bids on the work will
have been opened.
The City of Vernon reserves the right to reject any and
all bids or waive any informality in the bid.
