RESOLUTION NO. 4139
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING
CONTRACT NO. 371 FOR PAVE:MENT STRIPING FOR 1973, IN ACCORDANCE
WITH CONTRACT NO. 371 OF THE CITY OF VERNON

4 I THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS:
5 WHEREAS, there has been presented to the City Council of the
6 City of Vernon, Contract No. 371, providing for pavement striping
7 for 1973, within the City of Vernon, and
81 WHEREAS, the City Council of the City of Vernon has deter-
9 mined that it is in the best interests of the City that said Con-
10 tract be awarded in accordance with applicable State Laws,
11 NOW, THEREFORE, BE IT RESOLVED:

SECTION 1: That Contract No. 371 is hereby approved by the
13 City Council of the City of Vernon.

SECTION 2: That the City Clerk of the City of Vernon is
15 hereby directed to file in his Office in the City Hall, of the City
16 of Vernon, a copy of Contract No. 371.
17
SECTION 3: That the City Clerk of the City of Vernon is
18 hereby directed to give Notice, in writing, inviting sealed pro-
i
19 I posals or bids for pavement striping for 1973, in accordance with
I
20d Contract No. 371, and in accordance with this Resolution.

SECTION 4: There being no newspaper of general circulation
22 printed, published or circulated in the City of Vernon, the City
23 Clerk is hereby directed to post said Notice or cause the same to
24 be posted in three (3) of the most public places in the City of
25 Vernon, to wit: the northwest corner of 38th Street and Santa Fe
26 Avenue, the northeast corner of Leonis Boulevard and Pacific Boule-
27 vard, and on the bulletin board in the lobby of the City Hall of
28 the City of Vernon, located at 4305 Santa Fe Avenue in said City.

SECTION 5: The City Council of the City of Vernon has
30 ascertained the general prevailing rate of per diem wages and rates
31 for legal holidays and for overtime work in the locality in which
321 the work is to be performed, described in Contract No. 371, for

each craft or type of workman or mechanic needed to execute the
Contract which will be awarded to the successful bidder, and that
the general prevailing rate of per diem wages and rates for legal
holidays for overtime work in the locality of the execution of said
Contract No. 371 for each craft, classification or type of workman
needed is set forth in said Contract and incorporated by reference
at this point for all purposes as if set forth in full, and hereby
approved by the City Council of the City of Vernon.
SECTION 6: That the City Clerk of the City of Vernon is
10 hereby directed to post said Notice forthwith, and the first posting
11
of said Notice shall be not less than ten (10) days before the date
12 ofopening bids for the proposed work. That said Notice shall pro-
13 vide that sealed proposals or bids will be received by the City of
14 Vernon, California, at the office of the City Clerk of said City,
15
I at the City Hall, 4305 Santa Fe Avenue, Vernon, California, until
16

the hour of two o'clock (2:00) p.m., on the 6th day of February,
1973, and in accordance with Contract No. 371, approved by said CitYt

hereby given that sealed proposals or bids will be received by the I

City of Vernon, California, at the office of the City Clerk of said I
City, at the City Hall, 4305 Santa Fe Avenue, until the hour of
two (2) o'clock P.M. on the 6th day of February, 1973 for Pavement
Striping for 1973, in accordance with Contract No.. 371 approved by
said City.. The proposals will be publicly opened and read in the
Council Chambers of the City Hall located at 4305 Santa Fe Avenue,
Vernon, California, on the date and at the time above mentioned.
Specifications and contract documents may be obtained at the above-
mentioned office of the City Clerk.
The work to be done and materials to be furnished under said
Contract No. 371 are approximately as follows:

1 as a basis for the comparison of bids, and the City of Vernon does
2 not expressly or by implication, agree that the actual amount of
3 will correspond therewith, but reserves the right to increase or
4 crease the amount of any class or portion of the work, as may be
5 deemed necessary or expedient by the City.

All bids are to be compared on the basis of the Public
7 Works estimate of the quantities of the work to be done.
8 A representative from the Public Works Department will be
91 available to accompany prospective bidders for an inspection of the
10 work herein contemplated and contractors are urged to investigate
11 the location, character and quantity of work to be done, with a
12 representative of the Public Works Department

Each proposal must be accompanied by a statement of

Bidders are hereby notified that, pursuant to the
provisions of Sections 1770-1781, inclusive, of the Labor Code
of the State of California, the City Council of the City of
Vernon has ascertained the general prevailing rate of per diem
wages and rates for legal holidays and for overtime work in the
locality in which this work is to be performed, for each craft or
type of workman or mechanic needed to execute the contract which
,viII be awarded to the successful bidder, and that Resolution
9 No. 4139 , of the City of Vernon establishes said rates, and
10 is on file with the City Clerk of the City of Vernon.
11 Notice is further hereby given that all bidders may
12 submit with their bids a sworn statement of their financial
13 responsibility, technical ability and experience. Such sworn
14 statement may be required before award is made to any particular
15 bidder.
16 To be entitled to consideration, each bid submitted
17 pursuant to this notice shall be made out on a form to be
18 obtained at the Office of the Director of Public Works, shall' be
19 accompanied by a certified check, draft, or bid bond, payable at
20 a bank authorized to do business in the State of California,
21 made payable at sight to the City Clerk of the City of Vernon,
22 in an amount equal to ten per cent (10%) of the bid submitted,
23 shall be delivered to the City Clerk of the City of Vernon in a
24 sealed envelope at, or before, the time stated herein, and must
25
be plainly marked "Proposal for Contract No.
371 "
26 The above-mentioned check or bond shall be given as a
27 guarantee that the bidder will enter into a contract if awarded
28 to him and will be declared forfeited if the successful bidder
29 refuses or neglects to enter into a contract of the required' form
30 after being requested to do so by the City Clerk of the City of
31 Vernon, California. The successful bidder will be required to
32 furnish a labor and material bond in an amount equal to fifty

per cent (50%) of the contract price, and a faithful performance
bond in an amount equal to one hundred per cent (100%) of the
contract price.
Un12SS otherwise required by law, no bidder may with-
draw his bid for a period of thirty (30) days after the date set
for the opening thereof.
A deposit of ten dollars ($10.00) will be required to
secure the Plans and Specifications, as a guarantee that the
Plans and Specifications \..;7i11 be returned, which deposit will be
refunded in case same are returned to the City in good condition
not later than thirty (30) days after the bids on the Hork will
have been opened.
The City of Vernon reserves the right to reject any and
all bids or waive any informality in the bid.
