1 RESOLUTION NO. 4191
2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON, CALIFORNIA
PURSUANT TO SECTION 21023.6, GOVERNMENT CODE OF THE STATE OF CALI-
3 FORNIA
4 WHEREAS, the CITY OF VERNON, CALIFORNIA, (hereinafter
5 referred to as "Agency") is a contracting agency of the Public
6 Emp loyees' Retirement System; and
7 WHEREAS, the Public Employees' Retirement Law requires
8 that a contracting agency determine where an employee of such
9 agency in employment in which he is classified as a local safety
10 member is disabled for purposes of the Public Employees' Retire-
11 ment Law and whether such disability is "industrial" within the
12 meaning of such Law; and
13 WHEREAS, an application for disability retirement of
14 DALE L. BRITTINGHAM, employed by the Agency in the position of
15 Fireman, has been filed with the Public Employees' Retirement
16 System; and
17 WHEREAS, the City Council of the City of Vernon has
18 reviewed the medical and other evidence relevant to such alleged
19 disability;
20 NOW, THEREFORE, BE IT RESOLVED:
21 SECTION 1: That the City Council of the City of Vernon
22 finds and determines, and it does hereby find and determine that
23 DALE L. BRITTINGHAM is incapacitated within the meaning of the
24 Public Emp loyees' Retirement Law for performance of his duties in
25 the position of Fireman; and
26 NOW, THEREFORE, BE IT FURTHER RESOLVED:

SECTION 2: That the City Council of the City of Vernon
28 finds and determines, and it does hereby find and determine that
29 such disability is a result of injury or disease arising out of
30 and in the course of employment, and neither said DALE L. BRITTING
31 HAM, nor the Agency of the CITY OF VERNON has applied to the
32 Workmen's Compensation Appeals Board for a determination pursuant

1 to Section 21023.6 whether such disability is industrial; and
2 NOW, THEREFORE, BE IT FURTHER RESOLVED:

SECTION :3: That the City Council of the City of Vernon
4 does hereby certify that the member was separated from his emp10y-
5 ment in the position of Fireman effective August 29, 1973, and
6 that there is no question of the member having any additional bene-
7 fits that he may be entitled to under the law.

SECTION 4: That the City Clerk of the City of Vernon
9 shall certify to the passage of this Resolution and thereupon and
10 thereafter the same shall be in full force and effect.
