CALIFORNIA PURSUANT TO SECTION 21023.6, GOVERNMENT CODE OF THE STATE OF CALI - FORNIA , .... WHEREAS, the CITY OF VERNON, CALIFORNIA, (hereinafter - referred to as "agencyU) is a contracting agency of the Public " Employees' Retirement System; and WHEREAS, the Public Employees' Retirement Law requires that a contracting agency determine whether any employee of such agency in emplorment in which he is classified as a local safety member is disabled for purposes of the Public Employees' Retire- ment Law and whether such disability is "industrial" within the meaning of such Law; and WHEREAS, an application for disability retirement of ELDON G. SMITH, employed by the agency in the position of Polic - has been filed with the Public Employees' Retirement System; and WHEREAS, the City Council of the City of Vernon has reviewed the medical and other evidence relevant to such clisabilit ; NOW, THEREFORE, BE IT RESOLVED: SECTION i: That the City Council of the City of Vernon finds and determines, and it does hereby find and determine that ELDON G. SMITH is incapacitated within the meaning of the Public Employees' Retirement Law for the performance of his duties in the 23 position of Policeman; and 24 NOW, THEREFORE, BE IT FURTHER RESOLVED: 25 SECTION 2: That the City Council of the City of Vernon 26 finds and determines, and it does hereby find and determine that 27 such disability is a result of injury or disease arising out of 28 and in the course of employment, and neither said ELDON G. SMITH, 29 nor the agency of the CITY OF VERNON has app lied to the Workmen's 30 Compensation Appeals Board for a determination pursuant to Section 31 21023.6, whether such disability is undustrial; and 32 BOW, THEREFORE, BE IT FURTHER RESOLVED: -1- or 1 SECTION 3: That the City Council of the City of Vernon 2 does hereby certify tha the member shall be separated from his 3 employment in the position of Policeman effective January 19, 4 1974, and that there is no question of the member having any addi- 5 tiona1 benefits that he may be entitled to under the law. 6 SECTION 4: That the City Clerk of the City of Vernon 7 shall certify to the passage of this Resolution and thereupon and 8 thereafter the same shall be in full force and effect. 9 ADOPTED AND APPROVED this 2nd day of January, 1974. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ~ F. .: uUI~-. .
