RESOLUTION NO. 4198
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON, CALIFORNIA
~URStJANT TO SECTION 21023.6, GOVERNMENT CODE OF THE STATE OF . CALI-
FORNLt\. (JACK E. ANDERSON)
WHEREAS, the CITY OF VERNON, CALIFORNIA, (hereinafter
referred to as "AgencyH) is a contracting agency of the Public
Employees' Retirement System; and
WHEREAS, the Public Employees' Retirement Law requires
that a contracting agency determine whether an employee of such
Agency in employment in which he is classified as a local safety
member is disabled for purposes of the Public Employees' Retire-
ment Law and whether such disability is "industrial" within the
meaning of such Law; and
WHEREAS, an application for disability retirement of
JACK E. ANDERSON, employed by the Agency in the position of Fire-
man, has been filed with the Public Employees' Retirement System;

and
WHEREAS, the City Council of the City of Vernon has
reviewed the medical and other evidence relevant to such alleged
disability;
NOW, THEREFORE, BE IT RESOLVED:
SECTION 1: That the City Council of the City of Vernon
finds and determines, and it does hereby find and determine that
JACK E. ANDERSON is incapacitated within the meaning of the
Public Employees' Retirement Law for performance of his duties in
the position of Fireman;
NOW, THEREFORE t BE IT FURTHER RESOLVED:
SECTION 2: That the City Council of the City of Vernon
determines that there has been filed a petition with the WOrkmen's
Compensation Appeals Board for a detennination, pursuant to Sec-
tion 21023.6 of the Government Code, as to whether JACK E. ANDER-
SON, a Local Safety Member, has received a work-incurred disa-
bility, and whether the same is permanent and stationary and, if

1 so, the date when said disability became permanent and stationary.

SECTION 3: The City Clerk of the City of Vernon shall
3 certify to the passage of this Resolution and thereupon and there-
4 after the same shall be in full force and effect.
5 ADOPTED AND APPROVED this 17th day of January, 1974.
