Resolution No. 4230 RESOLUTION NO. 4230 1 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING CONTRACT NO. 376 FOR THE CONSTRUCTION. OF CITY HALL AND POLICE 3 FACILITY AND PARKING STRUCTURE AND FIRE DEPARTMENT SERVICE GARAGE, IN ACCORDANCE WITH CONTRACT NO. 376 OF THE CITY OF VERNON 4 5 THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS: 6 WHEREAS, there has been presented to the City Council of 7 the City of Vernon Contract No. 376, providing for the construction 8 of City Hall and Police Facility and Parking Structure and Fire 9 Department Service Garage, and 10 WHEREAS, the City Council of the City of Vernon has deter- 11 mined that it is in the best interests of the City of Vernon that 12 said Contract be awarded in accordance with applicable State Laws, 13 14 NOW, THEREFORE, BE IT RESOLVED: SECTION 1: That Contract No. 376 is hereby approved by 15 the City Council of the City of Vernon. 16 SECTION 2: That the City Clerk of the City of Vernon is 17 hereby directed to file at his office in the City Hall of the City 18 of Vernon a copy of Contract No. 376. 19 SECTION 3: That the City Clerk of the City of Vernon is 20 hereby directed to give Notice, in writing, inviting sealed pro- 21 posa1s or bids for the construction of City Hall and Police Faci- 22 1ity and Parking Structure and Fire Department Service Garage, in 23 accordance with Contract No. 376, and in accordance with this Reso- 24 1ution. 25 SECTION 4: There being no newspaper of general circula- 26 tion printed, published or circulated in the City of Vernon, the 27 City Clerk is hereby directed to post said Notice or cause the same 28 to be posted in three (3) of the most public places in the City of 29 Vernon, to wit: the northwest corner of 38th Street and Santa Fe 30 Avenue, the northeast corner of Leonis Boulevard and Pacific Bou1e- 31 vard, and on the bulletin board in the lobby of the City Hall of 32 the City of Vernon, located at 4305 Santa Fe Avenue in said City. -1- 1 SECTION 5: The City Council of the City of Vernon has 2 ascertained that the general prevailing rate of per diem wages and 3 the rates for legal holidays and for overtime work in the locality 4 in which the work is to be performed, described in Contract No. 5 376, for each craft or type of workman or mechanic needed to 6 execute the Contract which will be awarded to the successful bid- 7 der, and that the general prevailing rate of per diem wages and 8 rates for legal holidays, for overtime work in the locality of 9 the execution of said Contract No. 376 for each craft, c1assifica- 10 tion or type of workman needed is set forth in said Contract and 11 incorporated by reference at this point for all purposes as if 12 set forth in full and hereby approved by the City Council of the 13 City of Vernon. 14 SECTION 6: That the City Clerk of the City of Vernon 15 is hereby directed to post said Notice forthwith and the first 16 posting of said Notice shall be not less than ten (10) days before 17 the date of opening bids for the proposed work. The proposals will be publicly opened and 14 read in the Council Chambers of the City Hall located at 4305 Santa 15 Fe Avenue, Vernon, California, on the date and at the time above- 16 mentioned. Specifications and contract documents may be obtained 17 at the above-mentioned office of the City Clerk upon pay~ent of a 18 deposit of seventy five dollars ($75.00) for each specification. 19 The construction to be done and materials to be furnished under 20 said Contract No. 376 are as follows: 21 22 23 CITY HALL ~~ POLICE FACILITY AND PA]U{ING STRUCTURE FIRE DEPART~mNTSERVICE GARAGE The construction shall be in accordance with the Drawings and 24 Specifications and Contract No. 376 heretofore approved by the City 25 Council of said City, and now on file in the office of the City 26 Clerk of said City, a copy of which may be secured from the Directox 27 of Public Works. 28 Bidders are hereby notified that, pursuant to the provisions of 29 Sections 1770-l781, inclusive, of the Labor Code of the State of 30 California, the City Council of the City of Vernon has ascertained 31 the general prevailing rate of per diem wages and rates for legal 32 holidays and for overtime \-Jork in the locality in which this 'work -1- 1 is to be performed, for each craft or type of vprkman or mechanic 2 needed to execute the contract which will be awarded to the success 3 fu1 bidder, and that Resolution No. 4230 of the City of Vernon 4 establishes said rates, and is on file with the City Clerk of the 5 City of Vernon 6 Said rates and scales are herein referred to and adopted in 7 this Notice as though fully and completely set forth herein, and 8 said scale, as adopted by said resolution, is made a part of this 9 Notice by reference. 10 The City of Vernon hereby notifies all bidders that it will 11 affirmatively insure that in any contract entered into pursuant to 12 this advertisement, minority business enterprises will be afforded 13 full opportunity to submit bids in response to this invitation and 14 will not be discriminated against on the grounds of race, color, or 15 national origin in consideration for an award. 16 Minimum wage rates for this project as predetermined by the 17 Secretary of Labor are set forth in the Special Provisions. If 18 there is a difference between the minimum wage rates predetermined 19 by the Secretary of Labor and the prevailing wage rates deterrriined 20 by the City for similar classifications of labor, the Contractor 21 and his subcontractors shall pay not less than the higher wage rate 22 Notice is further hereby given that all bidders may submit 23 with their bids a sworn statement of their financial responsibility 24 25 26 27 28 29 technical ability and experience. Such sworn statement may be required before award is made to any particular bidder. To be entitled to consideration, each bid submitted pursuant to this notice shall be made out on a form to be obtained at the Office of the Director of Public Works; shall be accompanied by a certified check, draft or bid bond, payable at a bank authorized to do business in the State of California, made payable at sight to the City Clerk of the City of Vernon, in an amount equal to ten 30 31 32 percent (10%) of the bid submitted, shall be delivered to the City -2- .. 1 Clerk of the City of Vernon in a sealed envelope at, or before, 2 the time stated herein, and must be plainly marked, I'Bid on 3 Vernon City Hall and Police Facility and Fire Department Service 4 Gar age" . 5 The above-mentioned check or bond shall be given as a 6 guarantee that the bidder 'tv-ill enter into a, contract if a'tV'arded 7 to him and will be declared forfeited if the successful bidder 8 refuses or neglects to enter into a contract of the required 9 form after being requested to do so by the City Clerk of the City 10 of Vernon, California. The successful bidder will be required to 11 furnish a labor and material bond in an amount equal to one 12 hundred per cent (100%) of the Contract price, and a faithful 13 performance bond in an amount equal to one hundred per cent (100%~ 14 of the Contract price. 15 Unless otherwise required by law, no bidder may withdraw 16 his bid for a period of sixty (60) days after the date set for 17 the opening thereof. 18 A deposit of seventy five dollars ($75.00) will be required 19 to secure the Plans and Specifications, as a guarantee that the 20 Plans and Specifications will be returned, which deposit will be 21 refunded in case same are returned to the City in good condition 22 not later than thirty (30) days after the bids on the work will 23 have been opened. 24 The City of Vernon reserves the right to reject any and 25 all bids or waive any informality in the bid. 26 Dated at the Office of the City C1etk of the City of Vernon 27 28 29 30 31 32 this 16th day of April, 1974. ~ ...~ F.
