Resolution No. 4231 .. 1 RESOLUTION NO. 4231 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING CONTRACT NO. 376 FOR JAIL EQUIPMENT, IN ACCORDANCE WITH CONTRACT 3 NO. 376 OF THE CITY OF VERNON , 4 THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS: 5 WHEREAS, there has been presented to the City Council 6 of the City of Vernon Contract No. 376, providing for jail equip- 7 ment, and 8 WHEREAS, the City Council of the City of Vernon has deter- 9 mined that it is in the best interest of the City of Vernon that 10 said Contract be awarded in accordance with applicable state laws, 11 NOW, THEREFORE, BE IT RESOLVED: 12 SECTION 1: That Contract No. 376 is hereby approved by 13 the City Council of the City of Vernon. 14 SECTION 2: That the City Clerk of the City of Vernon is 15 hereby directed to file at his office in the City Hall of the City 16 of Vernon a copy of Contract No. 376. 17 SECTION 3: That the City Clerk of the City of Vernon is 18 hereby directed to give Notice, in writing, inviting sealed pro- 19 posa1s or bids for jail equipment, in accordance with Contract No. 20 376, and in accordance with this Resolution. 21 SECTION 4: There being no newspaper of general circu1a- 22 tion printed, published or circulated in the City of Vernon, the 23 City Clerk is hereby directed to post said Notice, or cause the 24 same to be posted in three (3) of the most public places in the 25 City of Vernon, to wit: the northwest corner of 38th Street and 26 Santa Fe Avenue, the northeast corner of Leonis Boulevard and 27 Pacific Boulevard, and on the bulletin board in the lobby of the 28 City Hall of the City of Vernon, located at 4305 Santa Fe Avenue 29 in said City. 30 SECTION 5: The City Council of the City of Vernon has 31 ascertained that the general prevailing rate of per diem wages and 32 the rates for legal holidays and for overtime work in the locality -1- .. 1 in which the work is to be performed, described in Contract No. 2 376, for each craft or type of workman or mechanic needed to 3 execute the Contract which will be awarded to the successful bid- 4 der, and that the general prevailing rate of per diem wages and 5 rates for legal holidays, for overtime work in the locality of 6 the execution of said Contract No. 376 for each craft, c1assifica- 7 tion or type of workman needed is set forth in said Contract and 8 incorporated by reference at this point for all purposes as if 9 set forth in full and hereby approved by the City Council of the 10 City of Vernon. 11 SECTION 6: That the City Clerk of the City of Vernon 12 is hereby directed to post said Notice forthwith and the first 13 posting of said Notice shall be not less than ten (10) days 14 before the date of opening bids for the proposed work. That said 15 Notice shall provide that sealed proposals or bids will be re- 16 ceived by the City of Vernon, California, at the Office of the 17 City Clerk of said City at the City Hall, 4305 Santa Fe Avenue, 18 Vernon, California 90058, until the hour of two (2) o'clock p.m., 19 on the 4th day of June, 1974, and in accordance with Contract No. 20 376 approved by said City. 21 22 23 24 25 26 27 28 29 30 31 32 SECTION 7: That the City Clerk of the City of Vernon shall certify to the passage of this Resolution and thereupon and thereafter the same shall be in full force and effect. The proposals will by publicly opened and read in the 12 Council Chambers of the City Hall located at 4305 Santa Fe Avenue. 13 Vernon, California 90058, on the date and at the time above Ulen- 14 tioned. Specifications and contract documents may be obtained 15 at the above-mentioned office of the City Clerk upon payment of 16 a deposit of seventy five dollars {$75.00) for each specification. 17 The materials to be furnished under said Contract No. 376 18 are as follows: 19 JAIL EQUIPMENT 20 The materials shall be in accordance with the Drawings and 21 Specifications and Contract No. 376 heretofore approved by the 22 City Council of said City. and now on file in the office of the 23 City Clerk of said City, copy of which may be secured from the 24 Director of Public Works. 25 Bidders are hereby notified that. pursuant to the provi- 26 sions of Sections 1770-1781, inclusive, of the Labor Code of the 27 State of California, the City Council of the City of Vernon has 28 ascertained the general prevailing rate of per diem wages and 29 rates for legal holidays and for overtiule work in the locality in 30 which this work is to be performed, for each craft or type of :31 worl~~an or mechanic needed to execute the contract which will be 32 awarded to the successful bidder, and that Resolution No. 4231 of -1- 9 - 1 2 :3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 :31 32 the City of Vernon establishes said rates, and is on file with the City Clerk of the City of Vernon. Said rates and scales are herein referred to and adopted in this Notice as though fully and completely set forth herein, and said scale, as adopted by said resolution is made a part of this Notice by reference. The City of Vernon hereby notifies all bidders that it will affirmatively insure that in any contract entered into pur- suant to this advertisement, minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award. Minimum wage rates for this project as predetermined by the Secretary of Labor are set forth in the Special Provisions. If there is a difference between the minimum wage rates predeter- mined by the Secretary of Labor and the prevailing wage rates determined by the City for similar classifications of labor, the Contractor and his subcontractors shall pay not less than the higher wage rate. Notice is further hereby given that all bidders may submit with their bids a sworn statement of their financial responsi- bility, technical ability and experience. Such sworn statement may be required before award is made to any particular bidder. To be entitled to consideration, each bid submitted pur- suant to this notice shall be made out on a form to be obtained at the Office of the Director of Public Works; shall be accompa- nied by a certified check, draft or bid bond, payable at a bank authorized to do business in the State of California, made pay- able at sight to the City Clerk of the City of Vernon, in an amount equal to ten percent (10%) of the bid submitted, shall be delivered to the City Clerk of the City of Vernon in a sealed envelope at, or before, the time stated herein, and must be -2- /; 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 " - 1 plainly marked, lfBid on Jail Equipment". 2 The above-mentioned check or bond shall be given as a 3 guarantee that the bidder will enter into a contract if awarded 4 to him and will be declared forfeited if the successful bidder 5 refuses or neglects to enter into a contract of the required form 6 after being requested to do so by the City Clerk of the City of 7 Vernon, California. The successful bidder will be required to 8 9 furnish a labor and material bond in an amount equal to one hun- dred per cent (100%) of the Contract price, and a faithful per- formance bond in an amount equal to one hundred per cent (100%) of the Contract price. Unless otherwise required by law, no bidder may withdraw his bid for a period of sixty (60) days after the date set for the opening thereof. A deposit of seventy five dollars ($75.00) will be required to secure the Plans and Specifications, as a guarantee that the Plans and Specifications will be returned, which deposit v7il1 be refunded in case same are returned to the City in good condition not later than thirty (30) days after the bids on the work will have been opened. The City of Vernon reserves the right to reject any and all bids or waive any informality in the bid.
