Resolution No. 4239 r 1 RESOLUTION NO. 4239 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON ESTABLISHING AN ACCEPTABLE PROCEDURE FOR ALLOCATION OF 1973 HIGHWAY ACT FUNDS 3 4 THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS: 5 WHEREAS, the Federal Aid Highway Act of 1973 extended the 6 permissable usage of Federal Aid Urban Systems (FAUS) funds beyond 7 simply street and highway projects and now allows for the purchase 8 of buses; the construction, reconstruction and improvement of 9 fixed rail facilities, including rolling stock for fixed rail; and 10 the construc~ion of exclusive or preferential bus, truck and emer- 11 gency vehicle routes or lanes; and 12 WHEREAS, the Federal Aid Highway Act of 1973 provides that 13 responsible local officials of an urbanized area can determine 14 whether a percentage of FAUS funds in their area should be expen- 15 ded on non-highway, public mass transit or on streets and highways; 16 and 17 WHEREAS, the California Department of Transportation, in its 18 guidelines on the local involvement required to determine the 19 appropriate procedures for expenditure of FAUS funds clearly calls 20 for a cooperative process involving cities, the county, the state, 21 and transit agencies; and 22 WHEREAS, there is a great deal of confusion as to the meaning 23 and interpretation of the proposed Urban Systems Procedure distri- 24 buted to cities in the Los Angeles County Division of the League; 25 and 26 WHEREAS, the cities in Los Angeles County should immediately 27 take initiative along with the County to establish acceptable pro- 28 cedures to protect the flow of funds amounting to approximately 29 $22 million prior to June 30, 1974, into Los Angeles County; 30 WHEREAS, the Board of Directors of the League of California 31 Cities has taken a strong position in support of the direct involve 32 ment of cities in the process of apportioning FAUS funds, rather -1- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 than simply having cities consulted in the process, thereby giving cities more control over how those funds will be spent in their own communities as well as in their region; and WHEREAS, the Los Angeles County Division of the League of California Cities has proposed a joint committee comprised of nine representatives (three each) appointed by the Division (one from Long Beach and two from cities other than Los Angeles and Long Beach), the City of Los Angeles, and the County of Los Angele;, thereby assuring that cities do have a direct involvement in es- tablishing procedures to be approved by the respective cities and the County; additionally three ex-officio, non-voting positions would be filled by the District Director of CALTRANS, the General Manager of SCRTD and SCAG. NOW, THEREFORE, BE IT RESOLVED: SECTION l: That the City of Vernon supports the active in- volvement of cities in the process of apportionment of FAUS funds within the County by means of a joint representative body as pro- posed by the Los Angeles County Division of the League of Cali- fornia Cities; and BE IT FURTHER RESOLVED: SECTION 2: That the joint committee be convened immediately so that a report may be distributed to the cities and to Los Angeles County for final consideration of multi-modal transporta- tion alternatives; and BE IT FURTHER RESOLVED: SECTION 3: That a copy of this Resolution be forwarded to the Los Angeles County Board of Supervisors, the Los Angeles County Division of the League of California Cities, the Director of District 7 CALTRANS, and the Director of the Department of Transportation of the State of California. ZIEMER CITY CLERK Ma yor City Council City Manager Public Works Director We sincerely regr~t the confusion which has developed over the procedures to be established for the alloca.tion of Federal Aid Urban Systems funds under the Federal Highway Act of 1973. Unfortunately, we were unable to review or comment on the proposed "Urban Systems Procedt,lres" dis~ tributed by the County of Los Angeles to each Mayor in the County on March 28. We feel that an appropriate review and mutually acceptable set of procedures should be jointly adopted which will protect the flow of funds under FAUS to the Cities in Los Angeles County and protect the financial options available for public transit proj ects eligible under the new legislation. The Los Angeles County Oivision fully supports the procedural guidelines established by the California Department of Transportation and the Urban Aid Systems Advisory Committee. We have proposed that a representative committee be convened immediately to recommend an appropriate alloca- tion process to the Cities and to the Board of Supervisors which can be mutually adopted. The attached resolution was unanimously adopted last evening by the Los Angeles County Division Board of Directors. We have developed it in a suggested resolution format so that it can be adopted by each City Council and distributed to the appropriate agency. Your response is essen- tial to indica te the support of formal review of the suggested procedures. A report will be distributed to all Cities this month for formal action at the next Los Angeles County Division Board of Directors meeting. Immediate action is essential to protect the flow of funds to the Cities in the County and to clarify the existing confusion with respect to interpretation of the procedures.
