OF THE CITY OF VERNON DETERMINING THE ,DISABILITY OF A ~AFETYMEMBER EMPLOYED BY THE CITY OF VERNON (SEC~ .2t023.6GOV~NT CODE) THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS: WHEREAS, the City of Vernon (hereinafter referred to as 6 "Agency") is a contracting Agency of the Public Employees Retire- 7 ment System; and 8 WHEREAS, the Public Employees Retirement Law requires that a 9 contract:LngAgency determine whether an employee of such Agency in 10 employment in which he is classified as a Local Safety Member is 11 disabled for purposes of the Public Employees Retirement Law, and 12 whether such disability is "industrial" within the meaning of such 13 law; and 14 WHEREAS, an Application for Disability Retirement of ROBERT H. 15 B09KHACKER~ employed by the Agency in the position of Chief of 16 Police, has or will be filed with the Public Employe,s Retirement 17 System, and 18 WHEREAS, the City Council of the City of Vernon has reviewed. 19 the medical and other ev:ldence relevant to such alleged disability; 20 NOW, THEREFORE, BE IT RESOLVED: 21 SECTION 1: That the City o:t Vernon find and determine, and 22 it does hereby rind and determine, that ROBERT H. BOCKHACKER is 23 incapacitated within the meaning of the Public Employees Retirement 24 Law for performance of his duties in the position as Chief of 25 Police of the City of Vernon; and 26 SECTION 2: That the City of Vernon find and determine, and 27 it does hereby find and determine, that such disability is not a 28 result of injury or disease arrising out of and in the course of 29 emp loyment, and neither said ROBERT H. BOCKHACKER nor the Agency of 30 the City of Vernon has applied to the Workmen I s Compensation Appeal 31 Board for a determination pursuant to Section 21023.6 of the Govern 32 ment Code, whether said disability is "industrial"; and -1- 6 " r . . ".. 1 SECTION 3: That no application to the Workmen's Compensa- 2 tion Appeals Board shall be made, as the City Council of the City 3 of Vernon determines that such disability has become permanent 4 and stationary. and effective October 1, 1974, said disability is 5 determined to be of a permanent nature and said ROBERT H. BOCK- 6 HACKER is removed from the City payroll, effective September 30, 7 1974. 8 SECTION 4: The City Clerk of the City of Vernon shall cer- 9 tify to the passage of this Resolution and thereupon and there- 10 after the same shall be in full force and effect. 11 ADOPTED AND APPROVED this 1st day of October, 1974. 12 13 14 ATTEST: 15 F.
