RESOLUTION NO. 4291
A RESOLUTION OF THE CITY'COUNCILd OF THE CITY OF VERNON DETERMININ
THEDISABILITYOF~ MEMBER, R.D. LINKE, PUR$UANT TO SEC'J:'ION
21023.6, GOVERNMENT CODE QF THE STATE OF CALIFORNIA
THE CITY COUNCIl., OF '!'HE CITY OF VERNON RESOLVES AS FOLLOWS:
WHEREAS, the CITY OF vERNON, CALIFORNIA, (hereinafter
referred to as "AgencyJf) isa contracting Agency of the Public
~ -*
Employees' Retirement System; and
WHEREAS, the Public Employees' Retirement Law requires that
. .
a contracting Agency determine whether an employee of such Agency
in employment in which he is classified as a Local Safety Member
is disabled for purposes of the Public Employees' Retirement Law
and whether such disability is "i.ndustria1ff within the meaning of
such Law; and
WHEREAS, an application for disability retirement of
R. D.L:t:NKE~ employed by the Agency in the position Police Officer
has been filed with the Public Employees' Retirement System; and
WHEREAS, the City Council of the City of Vernon has reviewed
the medi.cal. and other evidence relevant to such alleged disability;
NOW, THEREFORE, BE IT RESOLVED:
20 SECTION 1.: That the City Council of the City of Vernon finds
21 and determines, and it does hereby find and determine that Police
22 Officer R. D. LINKE is incapacitated within the meaning of the
23 Public Employees' Retirement Law for performance of his duties in
24 the position of Police Officer;
25 NOW, THEREFORE, BE IT FURTHER RESOLVED:
26 SECTION 2: That the City Council of the City of Vernon
27 determines that there has been filed a petition with the Workmen's
28 Compensation Appeals Board for a determination, pursuant to Sec-
29 tion 21023.6 of the Government Code, as to whether R. D. LINKE,
30 a Local Safety Member, has received a work-incurred disability,
31 and whether the same is permanent and stationary and, if so, the
32 date when said disability became permanent and stationary.

SECTION 3: The City Clerk of the City of Vernon shall
certify to the passage of this Resolution and thereupon and there
after the same shall be in fu11force and effect.
ADOPTED AND APPROVED this 1st day of October, 1974.
