Resolution No. 4303 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 '( 1 RESOLUTION NO. 4303 A RESOLUTION OF THE ern COUNCIL OF THE CITY OF VERNON, CALIFOR- NIA, PURSUANT TO SEC':['ION 21023.6, GOVERNMENT CODE: OF THE aTATE OF CALIFORNIA (OMER C.' SHERWOOD) WHEREAS, the CITY OF VERNON, CALIFORNIA, (hereinafter re- ferred to as "agencyft) is a contracting agency-of the Public Employees' Retirement System; and WHEREAS, the Public Employees' Retirement Law requires that a contracting agency determine whether any employee of such agency in emploYment in which he is classified as a local safety member is disabled for purposes of the Public Employees' Retire- ment Law and whether such disability is "industrial" within the meaning of such Law; and WHEREAS, an application for disability retirement of OMER C. SHERWOOD, employed by the agency in the position of Police man, hasbeen filed with the Public Employees' Retirement System; and WHEREAS, the City Council of the City of Vernon has reviewed the medical. and other evidence relevant to such disability; 20 SECTION 1.: That the City Council of the City of Vernon NOW, THEREFORE, BE IT RESOLVED: 21 22 23 24 25 26 27 28 29 30 31 32 finds and determines, and it does hereby find and determine that OMER C. SHERWOOD is incapacitated within the meaning of the Pub1i Employees' Retirement Law for the performance of his duties in the position of Policeman; and NOW, THEREFORE, BE IT FURTHER RESOLVED: SECTION 2: That the City Council of the City of Vernon finds and determines, and it does hereby find and determine that such disability is a result of injury or disease arising out of and in the course of emploYment, and neither said OMER C. SHERWOO , nor the agency of the CITY OF VERNON has applied to the Workmen's Compensation Appeals Board for adetennination pursuant to Sec- tion 21023.6, whether such disability is industrial; and -1- ; 1 2 "' NOW, THEREFORE, BE IT FURTHER RESOLVED: SECnON3: That the City Council of tne City of Vernon 3 does hereby certify that the member shall be separated from his 4 emploYment in the position of Policeman effective October 17, 5 1974, and that there is no question of the member having any 6 additional benefits that he may be entitled to under the law. 7 SECTION 4: That the City Clerk of the City of Vernon shall 8 certify to the passage of this Resolution and thereupon and there 9 after the same shall be in full force and effect. 10 ADOPTED AND APPROVED this 17th day of December, 1974. 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ~ F...
