Resolution No. 4341 .. ! .. .. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 , , RESOLUTION NO. 4341 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON, CALIFORNI CONSENTING TO ESTABLISHMENT OF PORTIONS OF OOWNEY ROAD AND _ ' FRUITLAND AVENUE WITHIN SAID CITY AS A PART OF THE SYSTEM ,OF COUNTY HIGHWAYS OF _ THE COUNTY OF LOS ANGELES THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS: WHEREAS, the Board of Supervisors did on May 13, 1975, dul adopt a Resolution declaring those portions of the hereinafter described highways as a part of the System of Highways of the County of Los Angeles, all as provided in Sections 1700 to 1704 inclusive of the Streets and Highways Code of the State of Cali- fornia; and WHEREAS, said Board of Supervisors by said Resolution re- quested this Council to give its consent to construct improvements and perform appurtenant work within said portions in the City of Vernon described below; and WHEREAS, pursuant to Section 15101, Class l(c) of the State Guidelines, the Secretary of Resources designates this type of project as categorically exempt; NOW, THEREFORE, BE IT RESOLVED: SECTION 1: Consent to Inclusion in County Highways System. 21 This City Council does hereby consent to the establishment of 22 those portions of the hereinafter described highways, and inter- 25 secting streets appurtenant to the construction thereof, within 24 the City of Vernon, as a part of the System of Highways of the 25 County of Los Angeles as provided in Sections 1700 to 1704 inclu- 26 sive of the Streets and Highways Code of the State of California. 27 Said consent is for the purpose of the aforementioned construction 28 of improvements and performance of appurtenant work by the County 29 of Los Angeles. 30 SECTION 2: Finding of Categorical Exemption. Please present this request for jurisdiction to your duly authorized City officials for their approval. The Public Resources Code provides that this type of project, by reason of the work proposed, does not have a significant effect on the environment. Accordingly and pursuant to Section 15101, Class 1 (c) of the State Guidelines for Implementation of the Environmental Quality Act of 1970, this project is declared to be categorically exempt from the provisions of said Act of 1970. If you concur that this project has no significant effect on the environment, please have your duly authorized City officials make a finding that it is, therefore, categorically exempt. Should you determine that the project may have a significant effect on the environment, we suggest that your Council find that the need for the improvement to meet the existing traffic requirements surpasses any possible adverse effects and the project should , .. The Council should also concurrently approve the County's request for jurisdiction: however, if the Council is unable to make one of the stated environmental findings, please defer Council action granting jurisdiction until the required environmental finding can be made. It should be noted that Sections 1701 and 1850 of the Streets and Highways Code provide that the City may consent to the County's request for jurisdiction by Resolution. In addition, Section 65402 (b) of the Government Code provides that the City Council may find in such Resolution that the project involves improvements of a minor nature. Enclosed is a draft of a Resolution containing the finding which, if enacted, will meet the requirements of these statutes and expedite the project. Please note that said draft also contains the finding that this project has no significant effect on the environment and is categorically exempt from the requirement for an Environmental Impact Report. When your City has adopted the Resolution or an Ordinance of consent, please send three conformed copies to Mr. I. L. Morhar, Road Commissioner. Thank you for your cooperation in this matter.
