RESOLUTION NOo 4350
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON FINDING
AND DETERMINING THE INCAPACITY OF ROBERT D. LINKE, POLIC EMAN,
PURSUANT TO SECTION 2102306, GOVERNMENT CODE OF, THE STATE OF
CALIFORNIA .
WHEREAS, the CITY OF VERNON, CALIFORNIA, (hereinafter
referred to as "agencytt) is a contracting agency of the Public
Employees' Retirement System; and
WHEREAS, the Public Employees' Retirement Law requires
that a contracting agency determine whether any employee of such
agency in employment in which he is classified as a local safety
member is disabled for purposes of the Public Employees' Retire-
ment Law and whether such disability is "industrial" within the
meaning of such Law; and
WHEREAS, an application for disability retirement of
ROBERT D. LINKE, employed by the agency in the position of Police-
"
man, has been filed with the Public Employee~' Retirement System;
and
WHEREAS, the City Council of the City of Vernon has re-
viewed the medical and other evidence relevant to such disability;
NOW, THEREFORE, BE IT RESOLVED:
SECTION 1: That the City Council of the City of Vernon
finds and determines, and it does hereby find and determine that
R.OBERT D. LINKE is incapacitated within the meaning of the Public
Employees' Retirement Law for the performance of his duties in
the position of Policeman; and
NOW, THEREFORE, BE IT FURTHER RESOLVED:
SECTION 2: That the City Council of the City of Vernon
finds and determines, and it does hereby find and determine that
such disability is a result of injury or disease arising out of
and in the course of employment, and neither said ROBERT Do LINKE
nor the agency of the CITY OF VERNON has applied to the Workmen's
Compensation Appeals Board for a determination pursuant to

Section 21023.6, Government Code of the State of California,
whether such disability is industrial; and
NOW, THEREFORE, BE IT FURTHER RESOLVED:
SECTION 3: That the City Council of the City of Vernon
does hereby certify that the member shall be separated from his
employment in the position of Policeman effective March 22, 1975,
and that there is no question of the member having any additional
benefits that he may be entitled to under.the law.
NOW, THEREFORE, BE IT FURTHER. RESOLVED:
SECTION 4: That the City Clerk of the City of Vernon
shall certify to the passage of this Resolution and thereupon and
thereafter the same shall be in full force and effect.
ADOPTED AND APPROVED this 15th Day of July, 1975.
