RESOLUTION NO. 4355
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING
CONTRACT NO. 396 AND, AUTHORIZING NOTICE INVITING SEALED PROPOSALS
OR BIDS FOR SLURRY SEALING FRUITLAND AVENUE, IN ACCORDANCE WITH
CONTRACT NO. 396 OF THE CITY OF VERNON
THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS:
WHEREAS, there has been presented to the City Council of
the City of Vernon, Contract No. 396 for Slurry Sealing Fruitland
Avenue; and
WHEREAS, the City Council of the City of Vernon has deter-
mined that it is in the best interests of the City of Vernon th8;t
said Contract be awarded in accordance with applicable state laws;
NOW, THEREFORE, BE IT RESOLV]!:D:
SECTION 1: That Contract No. 396 is hereby approved by
the City Council of the City of Vernon.
SECTION 2: That the City Clerk of the City of Vernon is
hereby directed to file in his office at the City Hall of the City
of Vernon a copy of Contract No. 396.
SECTION 3: That the City Clerk of the City of Vernon is
19 hereby directed to give Notice, in writing, inviting sealed pro-
20 posals or bids for Slurry Sealing Fruitland Avenue, in accordance
21 with Contract No. 396 and in accordance with this Resolution.

SECTION 4: There being no newspaper of general circula-
23 tion printed, published or circulated in the City of Vernon, the
24 City Clerk is hereby directed to post said Notice, or cause the
25 same to be posted, in three (3) of the most public places in the
26 City of Vernon, to wit: the northwest corner of 38th Street and
27 Santa Fe Avenue, the northeast corner of Leonis Boulevard and
28 Pacific Boulevard, and on the bulletin board in the lobby of the
29 Citr. Hall of the City of Vernon, located at 4305 Santa Fe Avenue
30 in said City.

SECTION 5: The City Council of the City of Vernon has
32 ascertained that the general prevailing rate of per diem wages

and the rates for legal holidays and for overtime work in the
locality in which the work is to be performed, described in
Contract No. 396, for each craft or type of workman or mechanic
needed to execute the Contract, which will be awarded to the
successful bidder, and that the general prevailing rate of per
diem wages and rates for legal holidays, for overtime work in
the locali~l of the execution of Contract No. 396, for each
craft, classification or type of workman or mechanic needed is
set forth in said Contract and incorporated by reference at this
point for all purposes as if set forth in full and hereby ap-
proved by the City Council of the City of Vernon.
SECTION 6 : That the City Clerk of the City of Vernon is
hereby directed to post said Notice forthwith and the first
posting of said Notice shall be not less than ten (10) days befor
the openin~ of bids for the l?roposed work. That said Notice shall
provide that sealed proposals or bids will be received by the
City of Vernon, California, at the Office of the City Clerk of
said City at the City Hall, 4305 SaIlta Fe Avenue, Vernon CA 90058

until the hour of two (2) o'clock P.M., on the l~th day of Sep-
tember, 1~75, and in accordance with Contract No. 396 approved by
said City.
SECTION 7: That the City Clerk of the City of Vernon
shall certify to the passage of this Resolution and thereupon and
thereafter the same shall be in full force and effect.

4 Pursuant to Resolution No. 4355 of the City of Vernon,
5 adopted on the 2nd day of September. 1975, directing same.
6 notice is hereby given that sealed proposals or bids will be
7 received by the City of Vem on, California, at the office of the
8 City Clerk of said City, at the City Hall, 4305 Santa Fe Avenue,
9 until the hour of two (2) o'clock P.M., on the 16th day of
10 September, 1975 for Slurry Sealing Fruitland Avenue in accor-
11 dance with Contract No. 396, approved by said City. The propo-
12 sals will be publicly opened and read in the Council Chamber of
13 the City Hall located at 4305 Sant Fe Avenue, Vernon, California.
14 on the date and at the time above mentioned. Specifications and

contract documents may be obtained at the above mentioned office
of the, City Clerk upon .' payment of a deposit of ten dollars
for each specification.
The construction to be done and materials to be furnishe
under said Contract No. 396 are approximately as follows:
FURNISH AND PLACE APPROXIMATELY 84 LONG TONS OF
SLUllRY SEAL
The construction shall be in accordance with Plans and
Contract No. 396 heretofore approved by the City Council of
said City, and now on. file in the office of the City Clerk of
said City, a copy of which may be secured from the Director of
Public Works.

1 Bidders are hereby notified that, pursuant to the
2 provisions of Sections 1770-1781, inclusive, of the Labor Code
3 of the State of California, the City Council of the City of
4 Vernon has ascertained the general prevailing rate of per diem
5 wages and rates for legal holidays and for overtime work in the
6 locality in which this work is to be performed, for each craft 01
7 type of workman or mechanic needed to execute the contract which
8 will be awarded to the successful bidder, and that Resolution
9 No. 4355 , of the City of Vernon establishes said rates, and
is on file with the City Clerk of the City of Vernon.
Notice is further hereby given that all bidders may
submit with their bids a sworn statement of their financial
responsibility, technical ability and experience. Such sworn
statement may be required before award is made to any particular
bidder.
To be entitled to consideration, each bid submitted
pursuant to this notice shall be made out on a form to be
obtained at the Office of the Director of Public Works, shall' be
accompanied by a certified check, draft, or bid bond, payable at
a bank authorized to do business in the State of California,
made payable at sight to the City Clerk of the City of Vernon,
in an amount equal to ten per cent (10%) of the bid submitted,
shall be delivered to the City Clerk of the City of Vernon in a
sealed envelope at, or before, the time stated herein, and must
be plainly marked "Proposal for Contract No.
396 "

The above-mentioned check or bond shall be given as a
guarantee that the bidder will enter into a contract if awarded
to him and will be declared forfeited if the successful bidder
refuses or neglects to enter into a contract of the required' form
after being requested to do so by the City Clerk of the City of
Vernon, California. The successful bidder will be required to
furnish a labor and material bond in an amount equal to fifty

per cent (50%) of the contract price, and a faithful performance
bond in an amount equal to one hundred per cent (100%) of the
contract price.

draw his bid for a period of thirty (30) days after the date set
for the opening thereof.
A deposit of ten dollars (SlO.OO) will be required to
secure the Plans and Specifications, as a guarantee that the
Plans and Specifications will be returned, which deposit will be
refunded in case same are returned tc the City in good conditicn
not later than thirty (30) days after the bids on the work will
have been opened.
The City of Vernon reserves the right to reject any and
all bids or waive any informality in the bi.d.
