A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON AUTHORIZING
THE DESTRUCTION OF CERTAIN CRIMINAL RECORDS UTILIZING THE STATE
OF CALIFORNIA CRITERIA. PURSUANT TO GOVERNMENT CODE SECTION 34090
. .
THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS:
WHEREAS. the Police Chief of the City of Vernon. under date
of October 8, 1975. has recommended that criminal records be
purged and destroyed in accordance with the criteria of the State
of California and in accordance with Government Code 5 34090. and
WHEREAS. the City Council of the City of Vernon finds that
none of the foregoing records would affect the title to real pro-
perty, or liens thereon. and
WHEREAS. the City Council of the City of Vernon finds that
pursuant to the criteria of the State of California that none of
said records are court records nor are records required to be kept
by statute, and that the same are more than seven (7) years old.
and that none of said records are minutes. ordinances or resolu-
tions of the legislative body of the City of Vernon. and
WHEREAS, the written consent of the City Attorney and the
Police Chief being the appropriate City department heads approve
the destruction of such records.

NOW. THEREFORE. BE IT RESOLVED:
SECTION 1: That the City Council of the City of Vernon does
hereby authorize the destruction by the Police Chief of the City
of Vernon of criminal records if the same are destroyed utilizing
the criteria of the State of California, without making a copy
thereof.
SECTION 2: That the City Council of the City of Vernon findf
that the same are no longer required for any purposes by the City
of Vernon.
SECTION 3: That any and all records. documents. instruments,
or papers referred to herein. and which may be destroyed. may not
be less than seven (7) years old.

SECTION 4:
The City Clerk of the City of Vernon shall
certify to the passage of this Resolution and thereupon and there-
after the same shall be in full force and effect.
ADOPTED AND APPROVED this 21st day of October. 1975.

The Office of the Attorney General has implemented a record
retention and purge program covering criminal records, under
which they review arrest records, and those exceeding reten-
tion requirements will be purged from the State files and !!!
data destroyed.
Under the provisions of California Government Code Section
34090, the head of a city department may destroy any city
record, document, instrument, book, or paper, under his charge
without making a copy thereof, after the same is no longer
required, With the approval of the legislative body of the
city (by a resolution), and the written consent of the city
attorney. The Attorney General is encouraging local agencies
to utilize this authority to purge their own criminal records,
based on the State criteria.
This purge program of the State Department of Justice will be
a continuing process, and it would be recommended that this
department adhere to this program.
It is, therefore, requested that we be authorized to purge our
criminal records, utilizing the State criteria, and a resolution
be drawn to this effect.
