" .. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15' 16 17 RESOLUTION NO. 4395 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON URGING THE ADOPTION OF ASSEMBLY BILL 3121 THE CITY COUNCIL OF THE Cln OF VERNON RESOLVES AS FOLLOWS: WHEREAS, Assemblyman Julian Dixon, along with other Cali- fornia Assemblymen, has endorsed important new juvenile justice legislation entitled ftA. B. 3121", and WHEREAS, the major features of the Bill provide that certain juveniles Who commit certain serious violent crimes may have the full range of adult sanctions; and that the District Attorney should appear on behalf of the People; and that the juve- nile court should primarily be concerned with the safety and pro- tection of the public; NOW, THEREFORE, BE IT RESOLVED: SECTION 1: That the City Council of the City of Vernon urges the Legislature of the State of California to adopt Assembly Bill 3121. 18 SECTION 2: That the City Clerk of the City of Vernon shall 19 I certify to the passage of this Resolution and thereupon and there- 20 after the same shall be in full force and effect. 21 22 23 ADOPTED AND APPROVED this 16th day of March, 1976. . ..) ~r. 24 25 26 27 28 29 ~ : .. B. 3121 DA TE: FEBRUARY 26, 1976 On February 18, 1976, Assemblyman Julian Dixon, along with seventeen other California Assemblymen, introduced an important new juvenile justice bill in the California State Legislature: A. B. 3121. This bill is a refinement of legislation offered in the prior year under bill number A. B. 1428. I regard the new bill asan extremely important measure which has the potential of working great improvements in the juvenile court system. It has four major features: 1. It provides that 16 and 17 year..old' s who commit such serious violent crimes as murder, robbery, rape, kidnapping, etc., may be charged by a District Attorney in the adult court, p:rovided the juvenile had what amounted to a prior felony conviction in the juvenile court. The purpose of this provision is to give us the opportunity to seek the full range of adult sanctions, including long term incarceration in appropriate cases. It is a discretionary rather than a mandatory provision. 2, It provides that the District Attorney is required to appear on behalf of The People when a petition alleges the minor has violated the law. This is a significant change, since the District Attorney now appears only at the invitation of the juvenile court. 3. The bill provides that one of the pr imary'goals of the juvenile court is the safety and protection of the public. Prior law had been cast towards a concern for and the welfare of the juvenile.. .. ... ( City Gouncils 2 February 26, 1976 4. The bill empower s Juvenile Courts to establish a Juvenile Conciliation Court to deal with minors accused of non-criminal conduct or offenses made crimes solely on the basis of their age on an informal basis. I am enclosing with this letter a copy of A. B. 3121. I ask that you examine it carefully. I urge that the members of your city council review the bill and urge that consideration be given towards the passage of a resolution in support of this very important measure. It's high time that we made needed reforms in the juvenile justice area, I strongly believe that this bill, which has wide acceptance, as the sponsorship of the bill indicates, is a positive step towards needed reform. It will next go to the Assembly Ways and Means Committee and will probably be heard sometime before the June 11 deadline. Although the bill was extensively amended in the Committee on May 5, I am very pleased that almost all of our original provisions have been retained. We did add provisions from some of the other measures before the Committee. These amendments provide counseling and shelter care service for runaways and truants and will help to separate the very young and inexperienced juvenile from the hard core offenders, providing more of an overall revision of the juvenile court system.
