RESOLUTION NO. 4407
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING
CO~RACT NO. 393. AND AUTHORIZING NOTICE INVITING SEALED PROPOSALS
OR BIDS FOR 45th STREET, 54th STREET AND.PACKERS AVENUE IMPROVE~
MENT,INACCORDANCE WITH CONTRACT NO. 393 OF. THE CITY OF VERNON
THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS:
WHEREAS, there has been presented to the City Council
of the City of Vernon, Contract No. 393 for 45th Street, 54th
Street and Packers Avenue Improvement, and
WHEREAS, the City Council of the City of Vernon has
determined that it is in the best interests of the Cfty of Vernon
that said Contract be awarded in accordance with applicable state
laws;
NOW, THEREFORE, BE IT RESOLVED:
SECTION-l:That Contract No.' 393 is hereby approved
15 by the City Council of the City of Vernon.

SECTION 2: That the City Clerk of the City of Vernon
17 is hereby directed to file in his office at the City Hall of the
18 City of Vernon a copy of Contract No. 393.

SECTION 3: That the City Clerk of the City of Vernon
20 is hereby directed to give Notice, in writing, inviting sealed
21 proposals or bids for 45th Street, 54th Street and Packers Avenue
22 Improvement, in accordance with Contract No. 393, and ill accor-
23 dance with this Resolution.

SECTION 4: There being no newspaper of gel1eral circula-
25 tion printed, pUblished or circulated in the City of Vernon, the
26 City Clerk is hereby directed to post said Notice, or cause the
27 same to be posted, in three (3) of the most public places in the
28 City of Vernon, to wit: the northwest corner of 38th Street and
29 Santa Fe Avenue; the northeast corner of Leonis Boulevard and
30 Pacific Boulevard; and on the bu1letill board in the lobby of the
31 City Hall of the City of Vernon, located at 4305 Santa Fe AVel1ue
32 in said City.

ascertained that the general prevailing rate of per diem wages
and the rates for legal holidays and for overtime work in the
locality in which the work is to be performed, described in
Contract No. 393, for each craft or type of workman or mechanic
needed to execute the Contract, which will be awarded to the
successful bidder, and that the general prevailing rate of per
diem wages and rates for legal holidays", fer overtime work in
the locality of the execution of Contract No. 393, for each
craft, classification or type of workman or mechanic needed is
set forth in said Contract and incerporated by reference at this
point for all purposes as if set forth in full and hereby approve
by the City Council ef the City of Vernon.
SECTION 6: That the City Clerk of the City ef Verno. is
hereby directed to post said Notice forthwith and the first
posting of said Netice shall be not less than ten (10) days befor
the opening of bids for the proposed work. That said Notice shall
provide that sealed propesals or bids will be received by the
City of Vernon, Califernia, at the Office ef the Citr Clerk ef
said City at the City Hall, 4305 Santa Fe Avenue, Vernen CA 90058,
until the hour eftwe (2) o'cleckP.M., ~n the 1st day ef june,
1976~ and in accerdance with Contract No. 393 approved by said
City.

SECTION 7: That the City Clerk ef the City ef Vernen shall
certify to the passage of this Resolution and thereupc;>n and
thereafter the same shall be in full ferce and effect.

1 Bidders are hereby notified that, pursuant to the
2 provisions of Sections 1770-1781, inclusive, of the Labor Code
3 of the State of California, the City Council of the City of
4 Vernon has ascertained the general prevailing rate of per diem
5 wages and rates for legal holidays and for overtime work in the
6 locality in which this work is to be performed, for each craft or
7 type of workman or mechanic needed to execute the contract which
8 \.olill be awarded to the successful bidder, and that Resolution
9 No. 4407, of the City of Vernon establishes said rates, and
10 is on file with the City Clerk of the City of Vernon.
11 Notice is further hereby given th~t all bidders may
12 submit with their bids a sworn statement of their financial
13 responsibility, technical ability and experience. Such sworn
14 statement may be required before award is made to any particular
15 bidder.
16 To be entitled to consideration, each bid submitted
17 pursuant to this notice shall be made out on a form to be
18 obtained at the Office of the Director of Public Works, shall' be
19 accompanied by a Certified check, draft, or bid bond, payable at
20 a bank authorized to do business in the State of California,
21 made payable at sight to the City Clerk of the City of Vernon,
22 in an amount equal to ten per cent (10%) of the bid submitted,
23 shall be delivered to the City Clerk of the City of Vernon in a
24 sealed envelope at, or before, the time stated herein, and must
25 be plainly marked "Proposal for Contract No. 393".
26 The above-mentioned check or bond shall be given as a
27 guarantee that.~he bidder will enter into a contract if awarded
28 to him and will be declared forfeited if the successful bidder
29 refuses or neglects to enter into a c,ontract of the required form
30 after being requested to do so by the City Clerk of the City of
31 Vernon, California. The successful bidder will be required to
32 furnish a labor and material bond in an amount equal to fifty

1 per cent (50%) of the contract price, and a faithful performance
2 bond in an amount equal to one hundred per cent (100%) of the
3 contract price.
4 Unless otherwise required by law, no bidder may with-
5 draw his bid for a period of thirty (30) days after the date set
6 for the opening thereof.
7 A deposit of ten dollars ($10.00) will be required to
8 secure the Plans and Specifications, as a guarantee that the
9 Plans and Specifications will be returned, which deposit will be
10 refunded in case same are returned to the City in good conditicn

11 not later than thirty (30) days after the bids on the work will
12 have been opened.
13 The City of Vernon reserves the right to reject any and
14 all bids or waive any informality in the bid.
