RESOLUTION NO. 4428
A RESOLUTION OF THE CITY COuNCIL OF THE CITY OF VERNON DETERMINING
THE DISABILITY OF CARLTON. E. ClAUNCH.. A LOCAL SAFETY MEMBER
EMPLOYED BY THE CITY OF VERNON (S2l0~5.4 GOVERNMENT CODE)
THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS:
WHEREAS, the City of Vernon (hereinafter referred to as
"AgencyU) is a contracting Agency of the Public EmployeesRetire-
ment System; and
WHEREAS, Public EmployeesRetirement System law requires
that a contracting Agency determine whether an employee of such
10 Agency, in employment in which he is classified as a Local Safety
11 Member, is disabled for the purposes of the Public Employees Retire
12 ment law, and whether such disability is Itindustrial" within the
13 meaning of such law; and
14 WHEREAS, an application for the disability retirement of
15 CARLTON E. CLAUNCH, employed by the Agency in the position of
16 Atitofireman, has been filed with the Public Employees Retirement
17 System, and
18 WHEREAS, the City Council of the City of Vernon has reviewed
19 the medica1'and other evidence relating to such disability,
20 NOW, THEREFORE, BE IT RESOLVED:

SECTION 1: That the City of Vernon finds and determines,
22 and it does hereby find and determine, that CARLTON E. ClAUNCH is
23 incapacitated within the meaning of the Public Emp10yees Retire-
24 ment law for performance of his duties as an Autofireman for the
25 City of Vernon.

SECTION 2: That the City of Vernon finds and determines,
27 and it does hereby find and determine, that such disability is a
28 result of injury arising out of and in course of employment, and
29 that CARLTON E. CLAUNCH and the Agency have agreed on the date of
30 retirement set forth herein, comprising the consent necessary
31 pursuant to Government Code 521025.4.

SECTION 3: That the City Council of the City of Vernon

1 determine that such disability became permanent and stationary
2 on September 9, 1975 and said disability is determined to be of a
3 permanent nature, and said CARLTON E. ClAUNCH is removed from the
4 City payroll effective September 9, 1975.

SECTION 4: That the City Clerk of the City of Vernon shall
6 certify to the passage of this Resolution and thereupon and there-
7 after the same shall be in full force and effect.
8 ADOPTED AND APPROVED this 3rd day of August, 1976.
