2 A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON DETERMINING THE DISABILITY
3 OF JA}1ES ROLAND TUCKER, A LOCAL SAFETY MEMBER
EMPLOYED BY THE CITY OF VERNON (S2l024 '&
4 21025 Government Code)
5 THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS:
6 WHEREAS, the City of Vernon (hereinafter referred to
7 as "Agency") is a contracting Agency of the Public Employees
8 Retirement System; and
9 WHEREAS, the Public Employees Retirement Law requires
10 that a contracting Agency determine whether an employee of such
11 Agency in employment in which he is classified as a Local Safety
12 Member is disabled for the purposes of the Public Employees
13 Retirement Law and whether such disability is "industrial"
14 within the meaning of such law; and
15 WHEREAS, an application for the disability retirement
16 of Mr. JAMES ROLAND TUCKER, employed by the Agency in the
17 position of Patrol Officer, has been filed with the Public
18 Employees Retirement System on March 28, 1977; and
19 WHEREAS, the City Council of the City of Vernon has
20 reviewed the medical and other evidence relevant to such alleged
21 disability.
22 NOW, THEREFORE, BE IT RESOLVED:
23 SECTION 1: That the City of Vernon find and determine

and it does hereby find and determine, that Mr. JAMES ROLAND
TUCKER is incapacitated within the meaning of the Public
Employees Retirement Law for performance of his duties ip the

position of Patrol Officer for the City of Vernon.

1 SECTION 2: That the City of Vernon find and determine
2 and it does hereby find and determine, that such disability is
3 a result of orthopedic injuries or disease arising out of and in
4 the course of employment and no determination is made herein in
5 relation to his alleged hypertensive cardiovascular disease.
6 Neither Mr. JAMES ROLAND TUCKER nor the Agency has applied to
7 the Workmen's Compensation Appeals Board for a determination
8 pursuant to Section 21026 as to whether such disability is
9 industrial.
10 SECTION 3: That the City Council of the City of Vernon
11 hereby determines that such disability became permanent and
12 stationary of May 16, 1977, and that said disability is
13 determined to be of a permanent nature, and said Mr. JAMES
14 ROLAND TUCKER is removed from the City payroll on December
15 13, 1977.
16 SECTION 4: That the City Clerk of the City of Vernon
17 shall certify to the passage of this Resolution and thereupon
18 and thereafter the same shall be in full force and effect.
19 ADOPTED AND APPROVED this 13th day of December, 1977.
