RESOLUTION NO. 4526
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON DETERMINING THE DISABILITY
OF DONALD ERWYN FISHER, A LOCAL SAFETY MEMBER
EMPLOYED BY THE CITY OF VERNON (~2l024 &
210.25 Government Code)
WHEREAS, the City of Vernon (hereinafter referred to
7 as "Agency") isa contracting Agency of the Public Employees
8 Retirement System; and

WHEREAS, the Public Employees Retirement Law requires
10 that a contracting Agency determine whether an employee of such
11 Agency in employment in which he is classified as a Local Safety
12 Member is disabled for the purposes of the Public Employees
13 Retirement Law and whether such disability is "industrial"
14 within the meaning of such law; and
15
WHEREAS, an application for the disability retirement
16 of MR. DONALD ERWYN FISHER, employed by the Agency in the
17 position of Lieutenant, has been filed with the Public Employees
18 Retirement System on August 24, 1975; and
19
WHEREAS, the City Council of the City of Vernon has
20 reviewed the medical and other evidence relevant to such alleged
21 disability.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
23 THE CITY OF VERNON AS FOLLOWS:

SECTION 1:
That the City of Vernon find and determine
25 and it does hereby find and determine, that MR. DONALD ERWYN
26 FISHER is incapacitated within the meaning of the Public
27 Employees Retirement Law for performance of his duties in the
28 position of Lieutenant for the City of Vernon.

SECTION 2:
That the City of Vernon find and determine
2 and it does hereby find and determine, that such disability is
3 a result of injury or disease arising out of and in the course of
4 employment and neither DONALD ERWYN FISHER nor the Agency has
5 applied to the Workmen's Compensation Appeals Board for a deter-
6 mination pursuant to Section 21026 whether such disability is
7 industrial.

SECTION 3:
That the City Council of the City of Vernon
9 hereby determines that such disability became permanent and
10 stationary on October 5, 1977, and that said disability is
11 determined to be of a permanent nature, and said DONALD ERWYN
12 FISHER is removed from the City payroll on October 6, 1975.

SECTION 4:
That the City Clerk of the City of
14 Vernon shall certify to the passage of this Resolution and
and thereafter the same shall be in full force and
15 thereupon
16 effect.
