A RESOLUTION OF THE CITY COUNCIL OF THE CITY

APPLICABLE.TOTHE,PIREDEPARTMENT
WHEREAS, the City of Vernon Labor Relations Consultant,
RICHARD S. WHITMORE, ESQ., for and on behalf of the City Municipal
Employee
Relations Representative, BRUCE V. MAL1(ENHORST, has
notified MR. RICHARD J. SILBER, ESQ., attorney and chief
negotiator for the Vernon Fire Fighters, Local 2312, that the
City intends to adopt layof~ procedures applicable to the Vernon
Fire Departmenti and,
WHEREAS, said notifications (March 22, 29, April .4, and
April 12, 1978) formally requested that the Vernon Fire Fighters,
Local 2312, meet and confer with the Municipal Employe,e Relat^ions
Representative of the City of Vernon to discuss said layoff
procedures; and,

SECTION 2:
The City of Vernon shall have the authority,
in its discretion, to determine the merits, necessity or organi-
zation of the services provided by the City of Vernon and pursuant

to such authority the City of Vernon may organizeqnd reorganize
the City Fire Department, determine organizational needs and
levels of service and may reduce or abolish positions.
SECTION 3: If the City of Vernon'takes action in
accordance with SECTION. 2 ,. herein and such action directly
affects the wages, hours,terms,andconditions.of::empl:loyment
of any bargaining unit members.,inclUd.ing the layoff of any
unit member, then the City agrees to meet and cOIlfer with the
employee representative in accordance ,with the following pro-
cedure:
(a) Within ten (10) days of the City action, the
employee representative shall request meeting and confeliring as
to the above-described effect of such actioni
(b) The request from the employee organization shall
describe the effect on wages, hours, terms and conditions ,of
employment which the City'? action has caused or will causei
(c) Meeting.'+and conferring shall occur within a
