Resolution No. 4568 ~ f 1 .;.J' ,~RESOLUTION NO. 4568 2 A RESOLUT~ON OF THE CITY COUNCIL OF THE CITY Op:VERN()N'A~NDING RE$OLUTION NO. 4150 IN ORDER TO INCORPORA'rE'AMEWDMENTS>10THE STATE ENVIRONMENTAL IMPACT REPORT GUIDELINES THROUGH AND H)lCLUl;>J;NG MAR~H 4, 1978 WHEREAS, the Ci,t:y COutlciLof the City of Vernon by 3 4 5 6 Resolution No. 4150 ~Qopted and i?<ffPRr~-ted into its City code, in full, the State Guidelines adopted by the State of California 7 8 pursuant to Assembly Bill No. 889i and 9 WHEREAS, said State Guidelines have been amended several 10 times since their inception in 1972i and 11 WHEREAS, the Resources Agency on January 25, 1978 12 13 14 adopted an amended Regulations of .the California Resources Agency to include in the State Environmental Impact Report Guidelines provisions conforming to Assembly Bill No. 884, which was adopted 15 by the State Legislature as Chapter 1200 of the statutes of 1977 16 17 and took effect on January 1, 1978i and WHEREAS, provisions of State law authorized the legis- 18 lative body of public agencies sixty (60) days from the effective 19 date oE the implementation of said guidelines in order to bring 20 21 their local procedure::; into conformity with said amended guidelines. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF 22 23 24 25 THE CITY OF VERNON AS FOLLOWS: SECTION 1: That the City Council of the City of Vernon does hereby determine that the recitals provided for hereinabove are true and correct. 26 SECTION 2: That the City Council of the City of Vernon 27 does hereby determine and provide that all amendments to the State 28 Environmental Impact Report Guidelines adopted by the State ~,~ ,,,~ 1 Resources. CALIFORNIA 90058 IN REPLY REFER TO: April 27, 1978 City Council City of Vernon 4305 Santa Fe Avenue Vernon, CA 90058 Re: Amendments to the State Guidelines Required by Assembly Bill No. 884 Honorable Members: Assembly Bill No. 884 was passed by the State Legislature during 1977 to take effect on January 1, 1978. Said Bill pro- vided for amendments to the State EIR Guidelines wherein said amendments will take effect on March 4, 1978. Public agencies are allowed sixty (60) days from the effective date of the State Resources Agency's actions ap- proving said amendments to State Guidelines to bring their own implementing procedures into conformity with said amend- ed guidelines. Therefore, public agencies should adopt prior to May 4, 1978 amendments to the State EIR Guidelines or adopt sufficient provisions in their individual codes so that their codes will be at least as stringent as the State EIR Guidelines. I have reviewed your prior Resolution No. 4150 which was adopted on March 20, 1973 and provided that the City of Vernon incorporated by reference for ail purposes as if set forth in full the State Guidelines adopted by the State of California as its Environmental Impact Code. .. City Council Page 2 April 27, 1978 In the event this honorable body wishes to continue to rely on the State Environmental Impact Report Guidelines, I have sub- mitted for your consideration the attached Resolution No. 4568, which by its terms would incorporate into the Vernon City Code the amendments to the State EIR Guidelines. However, the City Council may, if it wishes, adopt an in- dependant Environmental Impact Code which must contain provisions at least as strict as the State EIR Guidelines but, in some cases, could provide procedural elements adaptable to the city's unique circumstances.
