SAID CITY AS:PART OF THE SYSTEM OF HIGHWAYS OF. THE COUNTY OF LOS ANGELES AND APPROVING THE PROPOSED AGREEMENT BETWEEN THE CITY. OF VERNON AND THE COUNTY OF LOS ANGELES FOR RESURFACING THE ROADWA Y PAVEMENT OF DOWNEY. ROAD FROM FRUITLAND AVENUE · TO SLAUSON AVENUE AND AUTHORIZING THE EXECUTION THEREOF AND FINDING THAT THE PROJECT IS CA TEGORICALL Y EXEMPT 3 4' 5 6 7 8, 9 WHEREAS, the Board of Supervisors did on September 12, 1978, duly adopt a Resolution declaring that portion of Downey Road .from Fruit- .. land.Avenue to Slauson Avenue as part of theSystemofHighwa.ys of the County of Los Angeles, all as provided in Sections 1700 to 1704 inclusive of the Streets and Highways Code of the State of California; and WHEREAS, said Board of Supervisors by said Re$olution requ.ested this Council to give its consent to allow the County to constJ:uct improve- ments and perform appurtenant work within said portion in the City of Vernon described above; and WHEREAS, pursuant to Section 15101, Class 1(c) of the State Guide- lines, the Secretary of Resources designated this/type of project as categoricallyexernpt; and WHEREAS, the County of Los Ange les has submitted a proposed Agr~ement for resurfacing the roadway pavement of Downey Road from FrUitLand Avel1ue to~la~son Avenue in accordance with the Agreement attached hereto mC;t~E}tl.as Exhibit "A" and incorporated herein by this :\.t-",';'_,'~ . .: ". A G R E E M E N T 3~~82 THIS AGREEMENT made. and entered into by and between the CITY OF VERNON, a municipal corporation in the County of Los Angeles, hereinafter refer.re~ to as "CITY", and the COUNTY OF -LOS ANGELES,. a political subdivision.. of the State of California, hereinafter referred to as "COUNTY": W I T N E S S E T H WHEREAS, Downey Road is on CITY'S Select System of Streets and on COUNTY'S Master Plan of. Highv,~ays; and WHEREAS., the. roadway pavement.: on: Downey Road between Fruitland Avenue and Slauson Avenue has deteriorated and CITY and COUNTY propose to resurface that pavement, which work is hereinafter referred to as "PROJECT'° and WHEREAS, PROJECT is .within the jurisdictional limits of CITY, the City of Maywood. and. To furnish CITY, within 120 days after completion of PROJECT, a final accounting itemizing, by jurisdiction, actual unit costs and actual quantities for PROJECT. (3) IT IS MUTUALLLY UNDERSTOOD APdD AGREED AS FOLLOWS: a. The participating PROJECT cost, as referred to in thin-Agreement,. shall consist: of the costs of required materials, construction, final signing and striping, construction engineering, administration, and all -3 other work necessary to construct PROJECT in accordance i with approved. plans and. shall include currently effective percentages added to total salaries, wages, and equipment costs to cover-overhead,. administration, and depreci- ation in .connection with any orall of the aforemen- tinned items. .Non. participating PROJECT costs include` • the cost of preparing plans, specifications and cost t_ estimates. b. On the nomination form, sheet 2, Los Angeles County represented that the County could completethe preallocation requirements as set forth in Section 2456 of the Streets and HghT,~iays Code prior to April 1, 1978. By this statement the County represented-that the matters prerequisite to the award of the Construction Contract can be accompolshed within one year after the `allocation of funds or by April 1 19$0,. based upon one year between the allocation-and the award. of the.Construction Contract. In Supervisor Edleman's letter, he advised that he-had directed the Road Commissioner to start the design to clearly identify the right of way needs so that each jurisdiction can protect anal possibly acquire its own right of way.. ~1ze Road Commissioner has nominated the project for State Grade Separation funding, but-there has been no coizimunicaton to date from the public Utilities Commiss-ion, Caltrans or the County. Supervisor Edeloran''s letter also mentioned the possibility of Federal-aid Urban FU.nds. The preliminary Engineering project Report prepared by the County of Los-Angeles and dated.July, 1976 is available in the department. I do not understand th:e statement in Mr. B.eese's letter, "i.,f the City has more money that the County then the Gity would pay more"than the County." Also the public Utilities Commission is the state agency involved-with rail.road.crossings, not Caltrans. Caltrans and Public Utilities Commission may assist eac1-~. other as state agencies, The completion of the-"right of way determination is dependent upon receiving comments from the 1Jnion Pacific P.ail- road. The preliminary design.shows,substantially the same<>con figuration as the preliminary engineering report. While I agree that we should get together and discuss the financial arrangements, I suggest we wait until the right of way requirements have been identified and we have a better handle on the total project cost and the likelihood of receiving an allocation from the State Grade Separation Fund. The intersection of Band~ni Boulevard and Downey Road is locat a heavy concentration of business and industry. The existing volume of truck traffic (21% of vehicles), which is four times the County average -,for this type of :highway, the volume of automobile traffic and the daily train traffic on both the Union Pacific Railroad and the Santa Fe • Railway facilities immediately adjacent to Downey Road creates a daily condition of extreme conjestion. ~ - The current peak hour traffic volume on Bandini Boulevard is over 2,'100. The daily traffic volumes on Downey Road are nearly 26,000 vehicles 'south of and over '16,000. vehicles-north of~, Bandini Boulevard with. peak .hour volumes of over 2,300:. •Although this intersection is protected by four gates and flashez.~s, the- gate-vehicle accidents average over '100 a year, and the gates are broken off and not in use the majority of the time. APPENDIX 3 Sheet 3 of 3 When crossing blockage occurs, the closest alternate route that westbound emergency vehicles can take. across this line is at Washington Boulevard to the north, which encompases a circumbendibus trip of 5-1/4 miles or across District Boulevard to the south which encompasses a-trip of 3-3/4 miles. Therefore,-the lack of a viable" alternate route across this branch line, particularly for emergency vehicles, in addition to the high rate of train-vehicle congestion and gate accidents, increases the importance of this project. No more than 50~ of each City's proposed 1978-79 allocation, exclusive of carryover funds, will be assigned. The Board will assign the funds, if any, to individual cities by projects.
