2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON DETERMINING THE DISABILITY OF
3 JACK ANDERSON, A LOCAL SAFETY MEMBER EMPLOYED
BY THE CITY OF VERNON (~~2l024 & 21025 of
4 the Government Code)
5 WHEREAS, the City of Vernon (hereinafter referred to as
6 "Agency") is a contracting Agency of the Public Employees Retire-
7 ment Systemi and,
8 WHEREAS, the Public Employees Retirement Law requires
9 that a contracting agency determine whether an employee of such

10 Agency in employment in which he is classified as a Local Safety
11 Member is disabled for the purposes of the Public Employees
12 Retirement Law and whether such disability is "industrial" within
13 the meaning of such lawi and,

14 WHEREAS, JACK ANDERSON on June 26, 1978 filed an
15 application for disability. retirement and the Public Employees
16 Retirement System requested the City on July 20, 1978 to make
17 a determination regarding the disability of JACK ANDERSON; and,
18 WHEREAS, the City Council of the City of Vernon has re-
19 viewed the medical and other evidence relevant to such alleged
20 disability.
21 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
..22 THE CITY OF VERNON AS FOLLOWS:

SECTION 1:
That the City of Vernon find and determine
24 and it does hereby find and determine, that JACK ANDERSON is
25 incapacitated within the meaning of the Public Employees Retire-
26 ment Law for the performance of his duties in the position of
27 Fireman (Engineer 1) for the City of Vernon.

SECTION 2: That the City of Vernon find and determine

and it does hereby find and determine, that such disability is
2
a result of orthopedic injuries or disease arising out of and in
3
the course of employment and no determination is made herein in
4
relation to his alleged hypertensive cardiovascular disease.
5
Neither JACK ANDERSON nor the Agency has applied to "the Workers'
6
Compensation Appeals Board for a determination pursuant to
7
Section 21026 as to whether such disability is industrial.
8
SECTION 3: That the City Council of the City of Vernon
9
hereby determines that such disability became permanent and
10
11
stationary on September 1, 1978, and that such disability is
determined to be of a permanent nature, and said JACK ANDERSON
12 is removed from the City payroll on August 31, 1978.

SECTION 4~ That the City Clerk of the City of Vernon
14
shall certify to the passage of this Resolution and thereupon
15
and thereafter the same shall be in full force and effect.

ADOPTED AND APPROVED this 19th day of October, 1978.
