2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON DENYING THE DISABILITY OF RONALD L.
3 CUMMINGS, A LOCAL SAFETY MEMBER EMPLOYED BY
THE CITY OF VERNON (~~21024 & 21025 of the
4 Government Code)
5 WHEREAS, the City of Vernon (hereinafter referred to as
6 "Agency") is a contracting Agency of the Public Employees Retire....
7 ment System; and,
8 WHEREAS, the Public Employees Retirement Law requires
9 that a contracting agency determine whether an employee of such
10 Agency in employment in which he is classified as a Local Safety
11 Member is disabled for the purposes of the Public Employees
12 Retirement Law and whether such disability is "industrial" within
13 the meaning of such law; and,
14 WHEREAS, RONALD L. CUMMINGS on October 13, 1978 filed an
15 Application for Disability Retirement and the Public Employees
16 Retirement System requested the City on October 25, 1978 to make
17 a determination regarding the disability of RONALD L. CUMMINGS;
18 and,
19 WHEREAS, the City Council of the City of Vernon has re-
20 viewed the medical and other evidence relevant to such alleged
21 disability.
22 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
23 THE CITY OF VERNON AS FOLLOWS:

SECTION 1:
That the City of Vernon does hereby find
25 and determine that RONALD L. CUMMINGS is not incapacitated within
26 the meaning of the Public Employees Retirement Law for the
27 performance of his duties in the position of Fire Fighter for the
28 City of Vernon.

SECTION 2: That the City of Vernon does hereby find
and determine that such disability is not a ratable permanent
disability arising out of and in the course of employment and
neither RONALD L. CUMMINGS nor the Agency has applied to the
Workers' Compensation Appeals Board for a determination pursuant
to ~2l026 whether such disability is industrial.
SECTION 3: That the City CounciLof the City of Vernon
determines that RONALD L. CUMMINGS shall return to work effective
November 1, 1978.
SECTION 4: That the City Clerk of the City of Vernon
shall certify to the passage of this Resolution and thereupon and
thereafter the same shall be in full force and effect.
APPROVED AND ADOPTED this 11th day of January, 1979.
