A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON DETERMINING THE DISABILITY OF DONALD
E. PODLAS, A LOCAL SAFETY MEMBER EMPLOYED BY
THE CITY OF VERNON (~~21024 and 21025 of the
Government Code)

WHEREAS, the City of Vernon (hereinafter referred to as
7
"Agency") is a contracting Agency of the Public Employees Re-
8
tirement System; and,
9
WHEREAS, the Public Employees Retirement Law requires
10
that a contracting agency determine whether an employee of such
11
Agency in employment in which he is classified as a Local Safety
12
Member is disabled for the purposes of the Public Employees Re-
13
tirement Law and whether such disability is "industrial" within
14
the meaning of such law; and,
15
16
WHEREAS, by this Resolution the Agency is hereby filing
an application for the disability retirement of Donald E. podlas
17
employed by the Agency in the position of Captain in the CitY'Jof
18
Vernon2F.tre~Department; and,
19
WHEREAS, the City Council of the City of Vernon has
20
reviewed the medical and other evidence relevant to such alleged
21
22
disability.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
23
THE CITY OF VERNON AS FOLLOWS:

SECTION L: That the City of Vernon find and determine
and it does hereby find and determine that Donald E. podlas is
25
26
incapacitated within the meaning of the Public Employees Retire-
27
ment Law for performance of his duties in the position of Captain
28
in the City.of Vernon Fire Department.

SECTION 2: That the City of Vernon find and determine
2 and it does hereby find and determine, that such disability is a
3 result of injury or disease arising out of and in the course of
4 employment and neither Donald E. podlas nor the Agency has
5 applied to the Workers' Compensation Appeals Board for a determi-
6 nation pursuant to Section 21026 whether such disability is in-
7 dustrial.

SECTION 3: That the City Council of the City of Vernon
9 determines that such disability became permanent and stationary
10 on February 27, 1979, and said Donald E. podlas is removed from
11 the City payroll on August 16, 1978.

SECTION 4: That the City Clerk of the City of Vernon
13 shall certify to the passage of this Resolution and thereupon
14 and thereafter the same shall be in full force and effect.
