A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON DETERMINING THE NONINDUSTRIAL DISA-
BILITY OF ARTIE E. CHRISMAN, A LOCAL SAFETY
MEMBER EMPLOYED BY THE CITY OF VERNON (~~21024
& 21025 of the Government Code)

7 WHEREAS, the City of Vernon (hereinafter referred to as
8 "Agency") is a contracting Agency of the Public Employees Retire-
9 ment System; and,
10 WHEREAS, the Public Employees Retirement Law requires
11 that a contracting agency determine whether an employee of such
12 Agency in employment in which he is classified as a Local Safety
13 Member is disabled for the purposes of the Public Employees Re-
14 tirement Law and whether such disability is "industrial" within
15 the meaning of such law; and,
16 WHEREAS, the City Council of the City of Vernon has
17 reviewed the medical and other evidence relevant to such alleged
18 disability; and,
19 WHEREAS, ARTIE E. CHRISMAN has not filed an Application
20 for Retirement.
21 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
22 THE CITY OF VERNON AS FOLLOWS:

SECTION 1: That the City of Vernon does hereby find
24 and determine that ARTIE E. CHRISMAN is incapacitated within the
25 meaning of the Public Employees Retirement Law from the performanc
26 of his duties in the position of Captain in the Police Department
27 of the City of Vernon.

SECTION 2: That the City of Vernon does hereby find
1 and determine that such disability is not a ratable permanent
2 disability arising out of and in the course of employment and
3 neither ARTIE E. CHRISMAN nor the Agency has applied to the
4 Workers' Compensation Appeals Board for a determination pursuant
5 to ~21026 of the Government Code whether such disability is
6 industrial.

SECTION 3: That the City Council of the City of Vernon
8 determines that said disability is determined to be of a
9 permanent nature, and said ARTIE E. CHRISMAN is removed from the
10 City payroll on June 5, 1979.

SECTION 4: That the City, of--Vernon,:>by. this~Resolution,
12 is hereby filing an application for the nonindustrial disability
13 retirement of ARTIE E. CHRISMAN employed by the City in the
14 position of Captain in the Police Department of the City of
15 Vernon.

SECTION 5: That said nonindustrial disability was not
17 caused by third parties.

SECTION 6: That the City Clerk of the City of Vernon
19 shall certify to the passage of this Resolution and thereupon and
20 thereafter the same shall be in full force and effect.

APPROVED AND ADOPTED this 5th day of June, 1979.
