A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON DETERMINING THE DISABILITY OF
MICHAEL R. LEE, A LOCAL SAFETY MEMBER EMPLOYED
BY THE CITY OF VERNON (~~21024 & 21025 of the
Government Code)

WHEREAS, the City of Vernon (hereinafter referred to
8 as "Agency") is a contracting Agency of the Public Employees
9 Retirement System; and,
10 WHEREAS, the Public Employees Retirement Law requires
11 that a contracting agency determine whether an employee of such
12 Agency in employment in which he is classified as a Local Safety
13 Member is disabled for the purposes of the Public Employees Re-
14 tirement Law and whether such disability is "industrial" within
15 the meaning of such law; and,
16 WHEREAS, by this Resolution the Agency is hereby filing
17 an application for the disability retirement of MICHAEL R. LEE
18 employed by the Agency in the position of fireman; and,
19 WHEREAS, the City Council of the City of Vernon has
20 rev~ewed the medical and other evidence relevant to such alleged
21 disability.
22 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
23 THE CITY OF VERNON AS FOLLOWS:

SECTION 1: That the City of Vernon find and determine
25 and it does hereby find and determine, that MICHAEL R. LEE is
26 incapacitated within the meaning of the Public Employees Retire-
27 ment Law for the performance of his duties in the position of
28 fireman for the City of Vernon.

SECTION 2: That the City of Vernon find and determine
2 and it does hereby find and determine, that such disability is a
3 result of injury or disease arising out of and in the course of
4 employment and neither MICHAEL R. LEE nor the Agency has applied
5 to the Workers' Compensation Appeals Board for a determination
6 pursuant to ~21026 of the Government Code whether such disability
7 is industrial.

SECTION 3: That the City Council of the City of Vernon
9 determines that such disability became permanent and stationary
10 on November 20, 1978, and said disability is determined to be of
11 a permanent nature, and said MICHAEL R. LEE is removed from the
12 City payroll on June 5, 1979.

SECTION 4: That the City Council of the City of. Vernon
14 determ.ii1~s:t.ha:f such disability was not caused by third parties.

SECTION 5: That the City Clerk of the City of Vernon
16
shall certify to the passage of this Resolution and thereupon
17
and thereafter the same shall be in full force and effect.

APPROVED AND ADOPTED this 5th day of June, 1979.
