Resolution No. 4674 '*" .~.. .. .::'" I RESOLUTION NO. 4674 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON CONCURRING WITH AMENDMENT NO. 2 TO THE LOS ANGELES COUNTY SOLID WASTE MANAGEMENT PLAN 4 5 6 WHEREAS, the State Solid Waste Management Board approved 7 the Los Angeles County Solid Waste Management Plan on December 16, 8 1977 as meeting the requirements of Section 66780, Title 7.3 of 9 the Government Code; and 10 WHEREAS, during approximately one (1) year of imple- 11 mentation of the Plan a number of changes have occurred and 12 requests for revisions have been received which resulted in the 13 preparation of Amendment No. 2 to the County Solid Waste Manage~ 14 ment Plan; and 15 WHEREAS, the Amendment No. 2 is subject to the approval 16 by the majority of the cities within the incorporated area of 17 the County; and 18 WHEREAS, the Amendment No. 2 was submitted to the City 19 of Vernon for approval. 20 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF 21 THE CITY OF VERNON AS FOLLOWS: 22 SECTION I: That the City Council of the City of Vernon 23 does hereby find and determine that the recitals contained herein- 24 above are true and correct. 25 SECTION 2: That the City Council of the City of Vernon 26 hereby approves Amendment No.2. 27 SECTION 3: That the City Clerk of the City of Vernon 28 shall certify to the passage of this Resolution and thereupon and ~,J 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 , J';" thereafter the same shall be in full force and effect. Koonce~ (County Engineer) Chairman, County Solid Waste Management Committee. "Ba.ckground Information for Amendment No.2" and a "Sample Resolution concurring with Amendment Nc;>. 2" are enclosed. Sectio~ 7 of Amendment No.2 is "PROCEDURE FOR IN- CORPORATING NEW FACILITIES INTO CoSWMP". This procedure includes the following statement:. "j. Ba~~dupon the exercise of its police powers, the affect~d local jurisdiction may choose to approve or disapprove the new facility within its jurisdiction." Since the City will hav~ control of a solid waste facility propos;.ng to locate in- the City, itis recommended that the City concur and approv~ Amendment No.2 to the Los Angeles County Solid Waste Management Plan. BACKGROUND INFORMATION FOR AMENDMENT NO. 2 TO THE LOS ANGELES COUNTY SOLID WASTE MANAGEMENT PLAN '. Section 1 To receive as much input as possible, to provide continuity and to expedite the work of the Committee, there is a need for alternate members. This change would permit appointment by the original appointing authority of .a voting alternate member to serve in the absence of the original member. Section 2 These are minor administrative changes to eliminate the formal position of Secretary for the Committee. These modifications would not effect Committee operations. Section 3. This change would improve input to and functioning of the Committee by permitting the prompt replacement of members with repeated unexcused absences. Section' 4 The BKK Corporation transfer station, 3031 East I Street, Los Angeles was not included in the plan when it was prepared. Pursuant to a court settlement between BKK and the State Solid Waste Management Board, if the cities agree, the State Board will not object to the inclusion of BKK transfer station as an existing site. Section 5 The De Garmo Street .transfer station and the Universal By-Products transfer station.. both in the City of Los Angeles (Sun Valley) were not included in the CoSWMP when it was prepared. Both facilities have valid operating permits issued by the State Solid Waste Management Board. This change would correct the CoSWMP by including these existing facilities. Section 6 At the time the City of Los Angeles approved the original amendment to the CoSWMP (October 12, 1977) they also requested that an amendment be processed designating each of the various refuse collection district headquarters and service yards of the City of Los Angeles as transfer stations. In most cases these facilities handle small amounts of street sweeping and road maintenance wastes. They are not open to the public. ... .. .. ~ , f Section 7 By letter dated December 28,1977, the mayor and city administrator of each city were advised of the State Solid Waste Management Board's full approval of the County Solid Waste Management Plan. That letter also. transmitted a "Sununary of The Process for Incorporating Future Facilities into the Los' Angeles County Solid Waste Management Plan". The "Process" was not a part of CoS~IP but was a working agreement between the State Board staff and the County Solid Waste Management Committee. This. Section 7 incorporates that process into Appendix Z of the plan. The Committee has been fOllowing the process and it is appropriate to include' it in this amendment to CoSWMP. Section S. At the" time theCoSWMP was prepared, a number of tran~fer facilities proposed by the City of Los Angeles Bureau of Street Maintenance and Bureau of Sanitation were not included. These facilities are listed in Section 8. They would not be open to the public and would fa.cilitate waste handling operations of the'City of Los Angeles. Section 9 The Advance Recycling and Transfer Company facility, 2509 W. Rosecrans Avenue Compton, was not included in the CoSWMP when it was prepared. Pursuant to a court settlement between Advance Recycling and Transfer Co., and the State Solid Waste Management Board, if the cities agree, the State Board will not object to the inclusion of Advance Transfer Station as an existing si tee . .
