A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON AMENDING SECTION 4 OF RESOLUTION
NO. 4662 RESPECTING VACATION POLICIES FOR
EMPLOYEES OF THE CITY OF VERNON

6 WHEREAS, the City Council of the City of Vernon during
7 its regularly scheduled meeting on July 27, 1978, adopted
8 vacation policies applicable to employees of the Vernon Fire
9 Department; and
10 WHEREAS, the City Council of the City of Vernon approved
11 the re-emp10yment of the former employees of the Vernon Fire
12 Department who had previously been terminated without changing
13 said vacation policies approved on July 27, 1978; and
14 WHEREAS, the City Council of the City of Vernon desires
15 to amend Resolution No. 4662 to provide that the vacation policies
16 for employees in the Vernon Fire Department shall be in con-
17 formance with policies adopted on July 27, 1978.
18 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
19 THE CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Council of the City of Vernon does
21 hereby amend Resolution No. 4662, Section 4, to read as follows:
22
IISECTION-4: SHIFTS=CFIRE DEPARTMENT)

4.1. For the period commencing January 1, 1972, and
24 continuing thereafter through the calendar year ending December 31,
25 1976, Fire Department employees engaged in fire suppression shall
26 be annually scheduled to work for One Hundred Twenty-Two (122),
27 twenty-four (24) hour shifts.

4.2. Said One Hundred Twenty-Two (122) shifts shall con-

1 stitute the gross shifts to be scheduled from which the following
2 shifts shall be deducted annually as, and in lieu of, paid
3 vacations and holidays:
4 4.21. After completion of one (1) year or more
5 years of continuous service, but less than ten (10) years-twelve
6 (12) twenty-four (24) hour shifts.
7 4.22. After ten (10) years or more years of con-
8 tinous service, two (2) additional twenty-four (24) hour shifts.
9 4.3. The shifts which employees are entitled to deduct
10 pursuant to subsections 4.21 and 4.22 shall be scheduled as shifts
11 off on a year-around basis, subject to the following provisions:
12 4.31. Each employee must be scheduled for at least
13 five (5) consecutive shifts off during the anniversary year
14 following his anniversary date on which he became entitled to
15 deduct the shifts in question.
16 4.32. Each employee must be scheduled for all shift
17 which he is entitled to deduct as shifts off during the anni-
18 versary year immediately following the anniversary date on which
19 he became entitled to deduct such shifts.
20 4.33. Selection of shifts off shall be by rank and
21 according to seniority within rank.
22 4.34. No more than one (1) officer and no more than
23 three (3) employees in any platoon shall be scheduled off duty at
24 anyone time.
25 4.35. The selection of shifts off shall be made
26 annually for the following calendar year no later than December 31
27 of the immediately preceding calendar year.
28 4.36. Employees who are entitled to deduct two (2)

1 addi tiona1 shifts off pursuant to Subsection 2.22 shall have the
2 option to accept pay instead of time off at the employee's
3 salary schedule rate for such two (2) shifts, or to be scheduled
4 off duty for the additional two (2) shifts. This option must be
5 exercised simultaneously with the selection of shifts off duty
6 pursuant to Section 4.
7 Warrants shall be issued during the month of April
8 to all eligible Fire Department personnel who have selected the
9 option to accept pay instead of time off pursuant to this section.
10 The amount each eligible person shall receive shall be based on
11 his monthly salary as of April 1st of the current year. On
12 April 1st of each year, the Fire Chief shall submit to the City
13 C1erklDirector of Finance a certified list of Fire Department
14 personnel who are eligible to receive the extra weeks pay a$
15 authorized by this section.
16 4.37. The procedures andmechanic$ for the
17 scheduLing o.f shifts off and the. selection of scheduled shifts
18 off shall be established by the Fire. Chief in accordance with the
19 provisions of Subsection 4.3.
20 4.4. Any employee who is terminated $ha11 be paid upon
21 his termination for all unused sh.iftsoff to which he. became
22 entitled on his immediatelY preceding anniversary date, at his
23 hourly rate of pay.
24 4.5. Any employee who is permanently transferred out of
25 the fire s.uppression service. during an anniversary year shall be
26 paid for h.is unused shifts off to which he became entitled on h.is
27 immediately preceding anniversary date at his hourly rate and shall
28 become eligible for vacation benefits on his next following anni-

1 versary date in accordance with City Ordinances, Resolutions and
2 policies applicable to the classification in which he works.

4.6. Any employee with one (1) or more years of con-
4 tinuous service who is transferred to fire suppression during
5 an anniversary year shall be entitled to a proportionate number
6 of shifts off to be scheduled during the remainder of his current
7 anniversary year, unless he has already received the vacation
8 benefits to which he became entitled on his immediately preceding
9 anniversary date in his prior classification.

4.7. All permanent Fire Department personnel defined
11 as Safety Members by the Public Employees' Retirement System shall
12 be required to take an annual leave of absence from active duty
13 of not less than fifteen (15) consecutive days in accordance with
14 California Government Code ~53250."

SECTION 2: That the City Clerk of the City of Vernon
16 is hereby directed to certify to the passage of this Resolution
17 and thereupon and thereafter the same shall be in full force and
18 effect.
