Adoption of Resolution No. 4725
Gentlemen:
A general municipal election was held in the City of Vernon
on April 8, 1980. Mrs. Margarett J. Colbeth served as the
Inspector, Mrs. Rollande Looper served as the Judge, Mrs. Golda
D. Groom served as a Clerk, and Mr. Micheal L. Colbeth served
as a Clerk on the Vernon Precinct Board.
The Precinct Board transmitted to me at the close of the
election a combined Roster and Index and executed Certificates
by members of the Precinct Board certifying that 68 people voted
in said election. Copies of declarations of election officers,
a Challenge List, a Ballot Statement, Certificate of Performance,
a Tally Sheet, and an Index of Registered Voters are attached
hereto as Exhibit "1" and submitted herein for your consideration.
I received information prior to and during the conduct of
said election that certain irregularities had occurred which
could affect the final results of the election.

By letter dated April 8, 1980, I transmitted to Mr. Robert
A. Martinez, Deputy Special Investigations, District Attorney's
Office, a letter describing some of the irregularities with
copies of numerous documents in relation to said irregularities.
Attached hereto as Exhibit "2" is a copy of said letter and its
attachments pertaining to said irregularities.
In addition, I have requested David B. Brearley, the City
Attorney, to prepare a legal opinion to the City Council con-
cerning these irregularities and the affect these irregularities
have on your deliberations pursuant to Government Code S36812.
Mr. Mervish, the Chief Deputy City Clerk, and I, pursuant
to S22932.5 of the Elections Code and Resolution No. 4712, com-
pleted the canvass of the regular general municipal election,
and I submit herein as Exhibit "3" attached hereto the City
Clerk's Certificate of Canvass predicated upon all 68 votes
being accepted as legal votes for your consideration.
In addition, I submit herein as Exhibit "4" attached hereto
a second City Clerk's Certificate of Canvass which tallies the
votes independent of the alleged illegal votes cast and ap-
portions the alleged illegal votes to the challengers, Spencer
E. Hogan and Philip S. Reavis.
Also, enclosed for your consideration is a list of documents,
exhibits and statements identified as Exhibit "5" attached hereto
with said documents and statements attached which provide ad-
ditional information concerning the irregularities which occurred
during the general municipal election.
I will be available during the Council meeting to answer any
questions concerning the conduct of said election.

'At this time Officer Waller stated to the undersig~edthat he felt that he was being
unfairly treated by the City of Vernon by being }hequilhed to }hemain at th'is place of residence.
He fUl-ther stated that thi s residence \lias the Ci ty apartments at 3382 E. 50th Sb~eet. Offi ce\1
Haller1 further stated to the undersigned that he had been given a doctor's slip \'Jhichhe had
for\tmrded to the City, stating that he should be allowed to stay at this 'residence in the
City of Ojai for complete rest. Officer Haller further, stated to the undersigned that the
City had totally disregarded the doctor's request in regards to his staying at his reside:1ce
in Ojai and that Acting Chief Espinoza had advised him it \'Jould be best if he stayed at his'
residence in the City of Vernon, this t~esidence being"3382 E. 50th Street.
The undersigned at this time advised Officer Waller that; according to the Manual of
Policy and Ethics, he is required to remain at his residence and report to th~ station \.,hen
he leaves his residence and returns to the residence. The undersigned at this time advised
Officer Waller that hlS grievance would be filed along with the Step 2 provisions of thE
grievance procedure of the l'.1.0.U.. as it is the understanding of the undersigned that at the

Dear Mr. Martinez:
On M3rch 27t 1980 be Registrar-Recorder of Los Angeles County,
Mr. Leonard Panisht was advised that the Index of Registered Voters for
~e City of Vernon listed the names of Ronald L. and Deanne H. Hedlund with
two (2) residences loca ed at 2000 and 2200 E. Vernon Avenue (2 registrations
each) nei ber of which were legitimate residen'residential facilities.
Mr. Beckt of the R egistrar-Recorder's Office, assigned a field
deputy to investigate the premises. The field deputy talked to a Mr. Eli-
zzarriat at the Del Rey Cafet2000 E.. V~rnonAvenue, Vernon, California,
who stated that Mr. Hedlund did not reside at that addresst but that he had
given Mr. Hedlund permission to use the address as a mail drop.
Mr. Hedlund and Deanne Hedlund were challenged at the election of
April 8 and in answer to the challenget stated, after being swornt that they
were residents at 2000 E. Vernon Avenuet Vernon, California. I contacted Mr.
Beck afte~ I was informed that Mr. and Mrs. Hedlund had voted and he recom-
mended that I transmit this information to your office.
On April 8, Marjor-ie S. Garcia, who was evicted from city housing
at 3380 E. 50th Street in the early part of December 1979, attempted to vote
. in the municipal election and was challenged. The Registrar-Recorder records
show her listed as a resident at 2768-A E. 58th Street, Huntington Park,
California. Ms. Garcia responded to the challenge and was listed on the
inspector's list as eligible to vote under Section 202 of the Elections Code.

November 27, 1979. re: Eviction from City Housing.
(2) Copy of estimony given by Ms. Ga~cia in a recent Debtor's
Hearing on J~nuary 18, 1980, Huntington Park MunrcipalCourt, page 3, line
9. wherein she testified her present resident address at 2768-A East 58th
Street, Huntington Park~

Bankruptcy Court on February 25, 1980, which indicates that she resides

~rder upon Ms. Garcia on December 13, 1979.
On April 8, Carlton E. Claunch, who was ordered to vacate private
housing on April 27, 1979 by the owner of said house located at 2021 E. 38th
Street, attempted to vote in the municipal election and was challenged. Mr.
Claunch responded to the challenge and was listed on the Inspector's List
as eligible to vote under Section 202 of the Elections Code.
Enclosed herewith for your records are the following:
(1) A copy of the April 27, 1979 vacation notice from Mr. Czoke,
owner of the property.
(2) Copy of a June 13, 1975 office memorandum from John G. Ander-
son, Resident Health Inspector, indicating that the residence at said
address had been vacated;
Also, Mrs. Joann Fay Waller voted during said municipal election
claiming that she resided in City housing at 3382 E. 50th Street, Vernon.
However, Mrs. Waller resides at 309 Oriole, Ojai, California.
Enclosed herewith for your records are copies of documents where
Bert Waller, Mrs. Waller's husband, ,who was employed by the City of Vernon
Police Department, requested remporary leave of absence from Vernon for
medical recouperation purposes at Ojai, to stay with his wife in Ojai.

Mr. Micheal L. Colbeth voted during said municipal election, claiming
that he resided at 3550 E. Vernon Avenue, Vernon, California. However, Mr.
Colbeth moved from said address to 1800 State Street, Apartment 10, South
Pasadena, California during July of 1979 and has not resided at the Vernon
address since that time.
Enclosed herein is a copy of Motor Vehi,cles Department abstract in-'
dicating that he resides at 1800 State Street, Apt. #10, South Pasadena,
California, 91030.,
Ms. Dolores Alva also voted during said municipal election claim-
ing that she lived at 4317 Downey Road, Vernon, California. Said location is
a medical facility and not a residential facility. I have been informed that
she owns resident ialpremises in Monterey Park, where she spends most of her
time.
Mr. Spencer E. Hogan also voted during said election and in addition
was a 1 isted candidate for the counci Imanic office. Mr. Hogan was evicted.
from city-owned housing pursuant to Municipal Court judgment during December
1979 and he surrendered his premises on December 31, 1979. He stated for
purposes of voting that he resided at 2032 E. 45th Street, Vernon, California.
However, Mr. Hogan mainrnins residential premises in Ojai, where his wife
and children reside and I have been informed that no one has seen him reside
on 45th Street, and in fact he spends some time with his daughter in Downey.
Also enclosed for your records is a copy of a letter dated April
2, 1980 from Mr. Panish to me, as City Clerk, concerning persons regis ~ring
at non-residential addresses in the city.
Also enclosed is a copy of a ,letter dated April 7, 1980 from me,
as City Clerk, to Mrs. Colbeth, Inspector, Verhon Precinct No. 1 in relation
to challen ging and voting qualifications of specific individuals.
I also enclose a copy of a Motor Vehicle License abstract of Mrs.
Deanne Helen Hedlund, indicating that she~esides at 651 Exeter, La Habra,
Cal ifornia.
