RESOLUTION NO. 4744
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON ESTABLISHING A FEE AND PROVIDING
PROCEDURES FOR PUBLIC INSPECTION AND EXAMINATION
OF PUBLIC RECORDS, AND FOR OBTAINING COPIES OF
PUBLIC RECORDS OF THE CITY OF VERNON AND REPEALING
RESOLUTION NO. 4547
WHEREAS, the State Legislature of the State of Cali-
fornia has passed a California Public Records Act (Government
Code SS6250 through 6260), which is applicable to public agencies;
and
WHEREAS, the City Clerk's Department and other City
departments maintain certain records some of which may be defined
as "public records"; pursuant to Government Code SS6250 through
6260; and
WHEREAS, the California Public Records Act requires
that those records falling under the purview of said Act be open
for inspection by the public during normal office hours of the
office at which said records are located; and
WHEREAS, the City Council hereby finds and determines
that to inspect records or to determine whether said records fall
into the classification of public records and to allow the in-
'spection and reproduction of said records at the request of
public citizens causes the City to incur costs and expenses; and
WHEREAS, the City Council of the City of Vernon finds
and determines that the imposition of reasonable fees and costs
would be a fair and equitable way of allocating the cost of said
services; and
WHEREAS, S81008 of the Government Code provides that a

public agency may impose a fee of 10f1! per page for reproduction
of the specific records provided for in said section; and
WHEREAS, the City Council of the City of Vernon adopted
Resolution No. 4547 on May 2, 1978 establishing fees for the
inspection and reproduction of public records of the City of
Vernon in accordance with said Act.
WHEREAS, said fees established by said Resolution are
hereby determined to be inadequate.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: That the City Council of the City of Vernon
does hereby find and determine that the recitals contained herein-
above are true and ~orrect. '
SECTION 2: All public records of the City of Vernon
as defined in the Government Code of the State of California shall
be open to public inspection and examination and members of the
public may obtain copies thereof in accordance with the following
rules, regulations and procedures:
(A) Any person who desires to inspec~ examine, or
obtain a copy of a public record shall deliver to the office of
the City Clerk a written request therefor. Said request shall
supply sufficient information to enable the City Clerk to identify
and locate the same.
(B) Within five (5) working days after receiving
said written request the City Clerk shall notify the requesting
party if said documente~ists, if it is a public document open to
inspection and examination, the location of said document and the
person who may be contacted to arrange for inspection and exami-

(C) Within five (5) working days after receiving
3 a request for a copy of .a public document, the City Clerk shall
4 advise the requesting party of 'the existence of said document,
5 whether or not it is a public document, the location of said
6 document, the person from whom said document can be obtained and
7 the estimated cost thereof.

(D) That upon being advised of the estimated cost
9 of procuring a copy of said public document, the requesting
10 party shall deposit with the City Clerk the estimated cost
11 thereof.

(E) That upon receiving payment .of the estimated
13 cost of said docum~nt, the C~ty Clerk shall cause said document
14 to be copied' and shall furnish said copy to the requesting party,
15 as so.on thereafter as may be practical.

(F) That the cost that shall be charged by the City
17 for the copying of any document mentioned herein shall be not
18 less than the actual cost incurred by the City of Vernon therefor
19 but in no event shall be less than the sum of $2.00 for the first
20 three pages ,of legal size or smaller and $0.50. for each additiona
21 page of legal size or smaller thereof, or the approximate cost of
22 labor and material incurred by the City of Vernon.

(G) That in the event that the requesting party
24 shall require said document be certified, the City Clerk shall
25 certify the same upon the payment of an additional $1.00 for
26 each certification thereof.

(H) That the City Council of the City of Vernon
28 does hereby establish and approve a fee of $5.00 per public

record for inspection and an additional fee of $0.50 per page
for reproduction of said public record to be charged to the
citizen requesting the inspection and reproduction. However~ any
public records filed pursuant to ~81008 of the Governmertt Code
shall be reproduced at a charge of 10~ per page and the,in-
spection fee shall be waived.
SECTION 3: That the City Council of the City of Vernon
hereby instructs all department heads to apply the fees provided
for above and to select individuals in their department who will
be designated the evaluator who will be required to determine
whether a particular business record is open for public inspectio
or exempt pursuant to the laws of the State of California.
SECTION 4; That all: department heads shall prepare a
department policy for public access to records consistent with
the provisions of this Resolution.
SECTION 5: That the fees provided.for herein shall
be effective on July 15, 1980, and that Resolution No. 4547
and all other Resolutions in conflict herewith are herebY
repealed.
SECTION 6: That the City Clerk of the City of Vernon
shall certify to the passage of this Resolution and thereupon and
thereafter the same shall be in full force and effect.
