Resolution No. 4747 -, . 1 2 3 4 S 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 . - . ~ . , RESOLUTION NO. 4747 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING AN AMENDMENT TO THE ME~10RANDUM OF UNDERSTANDING BETWEEN THE MUNICIPAL EMPLOYEE RELATIONS REPRESENTATIVE OF THE CITY OF VERNON AND THE VERNON POLICE OFFICERS' BENEFIT ASSOCIATION-EMPLOYEE GROUP 2-(AUGUST 23, )..979 ,AS AMENDED ON DECEMBER 9, 1979 AND MARCH 27, 1980) WHEREAS, the Vernon Police Officers' Benefit Association has been recognized as an employee organization, pursuant to Resolution No. ~d27 of the City Council of the City of Vernon, and have met and cjonferred with the Municipal Employee Relations,Re- I presentative of the City of Vernon; and WHEREAS, members of'the Vernon Police Officers' Benefit Association representing Employee Group 2 had executed a Memorandu of Understanding with the Municipal Employee Relations Re- presentative of the City of Vernon, covering the period September ]., 1979 to and including August 31, 1982; and WHEREAS, the City Council of the City of Vernon pursuant to Resolution No. 4667 approved said Memorandum of Understanding; and WHEREAS, members of the Vernon Police Officers' Benefit Association representing Employee Group 2 had executed an Amendmen 24 Relations Representative of the City of Vernon on December 9 1979 ~o said Memorandum of Understanding with the Municipal Employee 25 26 27 28 amending Article 11 of said Memorandum of Understanding; and WHEREAS, the City Council of the City of Vernon pursuant to Resolution No. 4723 approved said Amendment to said Memorandum of Understanding; and ~., ~ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 . '. . , WHEREAS, members of the Vernon Police Officers' Benefit Association representing Employee Group 2 had executed an Amendmen to said Memorandum of Understanding with the Municipal Employee Relations Representative of the City of Vernon on March 27, 1980 amending Article 11 of said Memorandum of Understanding; and WHEREAS, the City Council of the City of Vernon pursuant to Resolution No. 4687 approved said Amendment to said Memorandum of Understanding; and WHEREAS, members of the Vernon Police Officers' Benefit Association representing Employee Group 2 have jointly met with the Municipal Employee Relations Representative of the City of Vernon and, pursuant to said meeting and conferring have executed an Amendment to saia Memorandum of Understanding amending Article 2, 22, and 23'of said Memorandum of Understanding; and WHEREAS, the City Council of the City of Vernon does hereby approve said Amendment to said Memorandum of Understanding. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: That the City Council of the City of Vernon does hereby approve and ratify the Amendment to Memorandum of Understanding between the Municipal Employee Relations Re- presentative of the City of Vernon and the Vernon Police Officers' ~enefit Association-Employee Group 2-(July 15, 1980) attached hereto as Exhibit "An and incorporated herein as though fully set forth at length. SECTION 2: That the approval and ratification set forth herein are subject to all the terms, covenants and conditions contained in said Amendment to said Memorandum of Understanding. -2- ..... & . 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24- 25 26 27 28 5 $ 2,333.00 per month 2.B Merit Steps 2.1B Promotions or salary increases to higher grades are merit steps only and shall be available to employees as recogni.tion and reward for satisfactory services after one (1) year in service at present grade. The promotion or salary increase to said higher grade shall remain in the sole discretion of the City Council. 2.2B Notwithstanding the above provisiori, any person employed in a position of Patrolmen I, Grade 4, shall be appointed to Grade 3 upon his successful completion in an assigned training academy and any person employed in a position of Patrolmen I, Grade 3, shall be appointed to Grade 2 after serving a't leas't six (6) months in the field and upon receiving a merit evaluation of high competent and any person employed in a position of Patrolmen I, Grade 2, shall be appointed to Grade 1 after serving at leas'i.: six months at said grade in the field and upon receiving a merit evaluation of high competent. Any person who qualifies for said increase shall have his anniversary date for future merit increases established as of the date said officer is appointed to said grade. 2.C Promotion 2.1C A Patrolmen I shall be eligible -8- " 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 to be promoted to a Patrolmen II position after serving at least twelve (12) months as a Patrolmen I, Grade 1, and upon receiving a satisfactory merit evaluation. 2.2C The promotion of a Patrolmen I to a Patrolmen II position shall not result in reduction in pay, and the Patrolmen I, being promoted shall be classified in such manner that he receives at least a five percent (5%) increase in pay for the position to which he is promoted. 2.D Premium Pay for Detective Assignments 2.1D A Patrolmen I or a Patrolmen II may' be assigned to the detective division to perform investigative services. 2.2D In the event a Patrolmen I or Patrolmen II is assigned to the detective division in accordance with Section 2.1D above said Patrolmen shall receive premium pay equal to One Hundred Twenty-Five Dollars ($125.00) per month and the premium pay shall not be con- sidered to be part of the employee's basic monthly salary when computing peace officers standards and training certificates incentives." 2. Article 22 is hereby amended to read as follows: "22. Term 22.1 The terms agreed upon by this Memorandum of Understanding shall take effect -9- 1 2 3 4 S 6 7 8 9 10 11 12 13 14 IS 16 17 18 19 20 21 22 23 24 25 26 27 28 upon approval by one or more Resolutions or Ordinances of the City Council of Vernon and shall remain in full force and effect until midnight, August 31, 1984. The Police Association hereby expressly waives any right to request any improvements or other changes in the wages, hours or other conditions of employment of employees in the classifications represented by the Police Association in Group 2, to take effect prior to August, 31, 1984, and Vernon shall not be required to meet and confer as to any such request. 22.2 If the Police Association desires to meet and confer with Vernon concerning improvements or changes in salaries, wages, hours or 'other conditions or employment to take effect on or about August 31, 1984, it shall serve upon the MERR a written request to meet and confer describing said improvements or changes no later than June 1, 1984." 3. Article 23 is hereby amended to read as follows: "23.
