Resolution No. 4781 ..._i"';-" . ..- .. . ," . 1 2 3 4 5 6 RESOLUTION NO. 4781 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON DETERMINING THE DISABILITY RETIREMENT OF PATRICK ANTHONY TAYLOR, A LOCAL SAFETY ME~ER, EMPLOYED BY THE CITY OF VERNON [~~2l024 and 21025 of the Government Code] WHEREAS, the City of Vernon (hereinafter r~ferred to 7 as the "Agency") is a contracting Agency of the Public Employees 8 Retirement System; and 9 WHEREAS, the Public Employees Retirement Law requires 10 that a contracting agency determine whether an employee of such 11 Agency in employment in which he is classified as a Local Safety 12 Member is disabled for the purposes of the Public Employees 13 Retirement Law and whether such disability is "industrial" within 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 the meaning of such law; and WHEREAS, by this Resolution the Agency is hereby filing an application for the disability retirement of Patrick Anthony Taylor employed by the Agency in the position of Lieutenant in the Vernon Police Department; and WHEREAS, the City Council of the City of Vernon has reviewed the medical and other evidence relevant to such alleged disability; and WHEREAS, such "industrial" disability was not caused by third party liability. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: That the City of Vernon hereby finds and determines that Patrick Anthony Taylor is incapacitated within the meaning of the Public Employees Retirement Law for performanc '. . . ,,' . - , r 1 of his duties in the position of Lieutenant in the Vernon Police 2 Department for the City of Vernon. 3 SECTION 2: That the City of Vernon hereby finds and 4 determines that such disability is the result of injury or 5 disease arising out of and in the course of employment and neither 6 Patrick Anthony Taylor nor the Agency has applied to the Workers' 7 Compensation Appeals Board for the determination pursuant to 8 S2l026 of the Government Code whether such disability is in~ 9 dustrial. 10 SECTION 3: That the City Council of the City of Vernon 11 determines that such disability became permanent and stationary 12 on February 13, 1981 and said disability is determined to be of a 13 permanent nature, and said Patrick Anthony Taylor is removed from 14 the City payroll on AP~;tl 7~ ,l9.'8I~, 15 SECTION 4: That the City Clerk of the City of Vernon 16 shall certify to the passage of this Resolution and thereupon 17 and thereafter the same shall be in full force and effect. 18 19 20 21 APPROVED AND ADOPTED this 7th day of Apr~Jh., 1981. ~ . - '4....a~ a .:t THOMAS A.
