Resolution No. 4816 .. l' 1 2 3 4 5 RESOLUTION NO. 4816 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON AMENDING SECTION 4 OF RESOLUTION NO. 4668 RESPECTING VACATION POLICIES FOR EMPLOYEES OF THE CITY OF VERNON AND REPEALING ALL RESOLUTIONS IN CONFLICT THEREWITH 6 WHEREAS, the City Council of the City of Vernon during 7 its regularly scheduled meeting on July 27, 1978, adopted 8 vacation policies applicable to employees of the Vernon Fire 9 Department; and 10 WHEREAS, the City Council of the City of Vernon 11 approved the re-employment of the former employees of the Vernon 12 Fire Department who had previously been terminated without 13 changing said vacation policies approved on July 27, 1978; and 14 WHEREAS, the City Council of the City of Vernon desires 15 to amend Section 4 of Resolution No. 4668 adopted on August 23, 16 1979, to provide that the vacation policies for employees in 17 the Vernon Fire Department shall be in conformance with policies 18 adopted on July 27, 1978. 19 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF 20 THE CITY OF VERNON AS FOLLOWS: 21 SECTION 1: The City Council of the City of Vernon does 22 hereby amend Section 4 of Resolution No. 4668 to read as follows: 23 24 25 26 27 28 "Section 4: SHIFTS (FIRE DEPARTMENT) 4.1 For the period conunencing January 1, 1972, and continuing thereafter through the calendar year ending December 31, 1976 , Fire Department employees engaged in fire suppression shall be annually scheduled to 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 work for one hundred twenty-two (l22), twenty-four (24) hour shifts. 4.2. Said one hundred twenty-two (l22) shifts shall constitute the gross shifts to be scheduled from which the following shifts shall be deducted annually as, and in lieu of, paid vacations and holidays: 4.2.l. After completion of one (l) year or more years of continuous service, bu't less than ten (10) years-twelve (1.2) twenty-four (24) hour shifts. 4.2.2. After ten (10) years or more years of continuous service, two (2) additional twenty-four (24) hour shifts. 4.3. The shifts which employees are entitled to deduct pursuant to subsections 4.2.l and 4.2.2 shall be scheduled as shifts off on a year-around basis, subject to the following provisions: 4.3.l. Each employee must be scheduled for at least five (5) consecutive shifts off during the anniversary year following his anniversary date on which he b~came entitled to deduct the shifts in question. 4.3.2. Each employee must be scheduled for all shifts which he is entitled to deduct as shifts off during the anniversary year immediately following the anniversary date on -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 which he became entitled to deduct such shifts. 4.3.3. Selection of shifts off shall be by rank and according to seniority within rank. 4.3.4. No more than one (l) officer and no more than four (4) employees in any platoon shall be scheduled off duty at any one time. 4.3.5. The selection of shifts off shall be made annually for the following calendar year not later than December 31 of the immediately preceding calendar year. 4.3.6. Employees who are entitled to deduct two (2) additional shifts off pursuant to subsection 4.2.2 shall have the ootion to accept pay instead of time off at the employee's salary schedule rate for such two (2) shifts, or to be scheduled off duty for the additional two (2) shifts. This option must be exercised simultaneously with the selection of shifts off duty pursuant to Section 4. Warrants shall be issued during the month of April to all eligible Fire Department personnel who have selected the option to accept pay instead of time off pursuant to this Section. The amount each eligible person shall receive shall be based on his monthly -3- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 salary as of April lst of the current year. On April lst of each year, the Fire Chief shall submit to the City Clerk/Director of Finance a certified list of Fire Department personnel who are eligible to receive the extra weeks pay as authorized by this Section. 4.3.7. The procedures and mechanics for the scheduling of shifts off and the selection of scheduled shifts off shall be established by the Fire Chief in accordance with the provisions of subsection 4.3. 4.4. Any employee who is terminated shall be paid upon his termination for all unused shifts-off to which he became entitled on his immediately preceding anniversary date, at his hourly rate of pay. 4.5. Any employee who is permanently transferred out of the fire suppression service during an anniversary year shall be paid for his unused shifts off to \vhich he became entitled on his immediately preceding anniversary date at his hourly rate and shall become eligible for vacation benefits on his next following anniversary date in accordance with City Ordinances, Resolutions and polices applicable to the classification in which he works. 4.6. Any employee with (l) or more years of continuous service who is transferred to fire -4- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 suppression during an anniversary year shall be entitled to a proportionate number of shifts off to be scheduled during the remainder of his current anniversary year, unless he has already received the vacation benefits to which he became entitled on his immediately preceding anniversary date in his prior classification. 4~7. All permanent Fire Department personnel defined as Safety Members by the Public Employees' Retirement System shall be required to take an annual leave of absence from active duty of not less than fifteen (l5) consecutive days in accordance with California Government Code ~53250.11 SECTION 2: That in all other particulars, Resolution No. 4668 shall remain in full force and effect and that any resolution not consistent with or in conflict with this Resolutio is hereby repealed, specifically Resolution No. 4706. SECTION 3: That the City Clerk of the City of Vernon is hereby directed to certify to the passage of this Resolution and thereupon and thereafter the same shall be in full force and effect.
