Resolution No. 4835 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 4835 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON REQUESTING THE LOS ANGELES COUNTY BOARD OF SUPERVISORS TO STOP PROVIDING GENERAL FUND SUBSIDY ~O LOS ANGELES COUNTY ANIMAL CONTROL CONTRACT SERVICE AREAS WITHOUT EQUITABLE DISTRIBUTION OF FUNDS TO ALL COMMUNITIES WHEREAS, the Los Angeles County Grand Jury Audit reP9rt identified a substantial subsidy from the General Fund to pay for Animal Control services rendered to unincorporated and contract in agencies; and WHEREAS, the above subsidy is estimated to exceed $3 million for the fiscal year of 1981-1982 of which approximately $1.2 million is used to underwrite Animal Control services in County contract areas; and WHEREAS, there exists indisputable evidence that County Animal Control services inure to the benefit only of persons residing within the County Animal Control service areas and not the entire County; and WHEREAS, the above-referred audit report excerpt entitle "Exhibit II" and "Exhibit III" attached hereto and made a part hereof as Exhibits "A" and "A-l", respectively, clearly demonstrates the inequitable distribution of services and related charges which reflect an enormous subsidy to certain areas; and WHEREAS, County Animal Control now attempts to influence and inhibit Cities in their pursuit of alternative economical Animal Control: services by utilizing vast financial resources gained from inequitable distribution of County General Fund revenues; and I \ 1 tVREREAS, a substantial amount of County General Fund 2 revenues is derived from persons within this City with the intent 3 to operate services that benefit the entire County, including 4 residents of this City; and 5 WHEREAS, this City already pays for taxes in Animal 6 Control services and is now required to subsidize County Animal 7 Control services in other communities from general property 8 taxation without any direct or indirect benefit to the residents 9 of this community or a pro rata share of the subsidy to the 10 County; and 11 WHEREAS, this inequity is tantamount to double taxation. 12 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF 13 THE CITY OF VERNON AS FOLLOWS: 14 SECTION 1: That the City Council of the City of Vernon 15 hereby finds and determines that the recitals contained herein- 16 above are true and correct. 17 SECTION 2: That the Mayor of the City of Vernon is 18 hereby directed to request that the Board of Supervisors of the 19 County of Los Angeles take immediate steps to stop County Animal 20 Control from providing subsidy to any contract service area 21 unless the Board similarly provides funds to this City for 22 Animal Control services in amounts to be determined on a per 23 capita or pro-rata contribution method. 24 SECTION 3: That if no satisfactory solution to this 25 matter is reached within a reasonable period of time, the City 26 Attorney shall prepare a report to this Council on alternative 27 steps which may be deemed appropriate. 28 SECTION 4: That the City Council of the City of Vernon -2- ... .. 1 hereby urges all cities within Los Angeles County to respond 2 to this matter with like resolve. 3 SECTION 5: That the City Clerk of the City of Vernon 4 shall certify to the passage of this Resolution and thereupon 5 and thereafter the same shall be in full force and effect. 6 APPROVED AND ADOPTED this 18th day of August, 1981. 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ~.. .~ EONIS C.~ ATTEST: g~~#~ BRUCE V. ~~LKENHORST, City Clerk -3- , 1 STATE OF CALIFORNIA ) ) SSe 2 COUNTY OF LOS ANGELES ) 3 4 I, BRUCE V.
