RESOLUTION NO. 4845
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON APPROVING THE EXECUTION OF AN
AMENDMENT TO .THETHIRD CONTRACT BY AND BETWEEN
BETHLEHEM STEEL CORPORATION AND THE CITY OF
VERNON WHICH PROVIDES FOR ELECTRICAL SERVICES
6 WHEREAS, the City Council of the City of Vernon
7 approved the Third COntract For Electrical Service py and between.
8 Bethlehem Steel Corporation and the City of Vernon on July 7,
9 1981; and
10 WHEREAS, the City Council of the City of Vernon desires
11 to amend "Section 2" of said Contract toteflect a change in
12 "on-peak" period under the new TOU-R schedule.
13 NOW t THEREFORE, BE.IT RESOLVED BY THE CITX COUNCIL OF
14 THE CITY OF VERNON AS FOLLOWS:

SECTION 1: That the City Council of the City of Vernon
16 does hereby find and determine that the recitals. contained
17 hereinabove are true and correct.

SECTION 2: That the City Council of the City of Vernon
does hereby approve the Amendment to the Third Contract For
Electrical Service; which is attached hereto as Exhibit "A" and
incorporated herein by this reference as though fully set forth
at length, effective October 7, 1981.
SECTION 3: That the Mayor and the City Clerk are
hereby authorized to execute said Amendment to the Third. Contract

SECTION 4: That the City Clerk of the City of Vernon
2 shall certify to the passage of this ReSOlution and thereupon
3 and thereafter the same shall be in full force and effect.
4 APPROVED AND ADOPTED this 6th day of October, 1981.

THIRD CONTRACT FOR ELECTRICAL SERVICE
THIS AMENDMENT TO THIRD CONTRACT FOR ELECTRICAL SERVICE is made,
entered into and executed in duplicate originals, either copy of which may
be considered and used as the original hereof for all purposes, and to be
performed in Vernon, California as of the 6th day of
October
, 1981

Corporation (hereinafter
referred to as "City")

AND
BETHLEHEM STEEL CORPORATION
(hereinafter referred to as
"Bethlehem Steel")
Pacific Coast Division
3300 East Slauson Avenue
Vernon, CA 90058
RECITALS
WHEREAS, the City and Bethlehem Steel have heretofore entered into
a Third Contract for Electrical Service effective July 15, 1981, which was
approved by the City on July 7, 1981; and
WHEREAS, the City desires to amend "Section 2" of said Contract to
reflect a change in "on-peak" period under the new TOU-R schedule.
NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS, PROMISES
AND CONDITIONS HEREINAFTER SET FORTH, THE PARTIES HERETO AGREE AS FOLLOWS:

SECTION l~ That Section 2 of said Contract shall be amended to
be effective October 7, 1981, and shall read as follows:
SECTION 2: "On-Peak" Periods Defined.
The "on-peak" period is defined as weekdays from 1:00 p.m.
to 7:00 p.m. commencing at 12:01 a.m. May 1 and continuing through
October 31 of each year and weekdays from 5:00 p.m. to 10:00 p.m.
commencing at 12:01 a.In. November 1 and continuing through April 30 of
the following year, each exclusive of hOlidays. Holidays include New
Year's Day, Washington's Birthday, Memorial Day, Independence Day, Labor
Day, Veteran's Day, Thanksgiving Day, and Christmas.
SECTION 2: That in all other respects except as hereinabove
provided the terms and conditions of the Third Contract For Electrical
Service approved by the City Council on July 7, 1981, shall remain in
full force and effect.
IN WITNESS WHEREOF, the 9arties hereto have executed this
Amendment to the Third Contract For Electrical Service, or caused it to
be executed as of the day, month and year first above written.
