RESOLUTION NO. 4856
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON ACCEPTING THE WORK FOR SOTO STREET,
26TH STREET AND 50TH STREET IMPROVEMENT IN
ACCORDANCE WITH CONTRACT NO. 440 OF THE CITY
OF VERNON
6 WHEREAS, EXCEL PAVING COMPANY was awarded the contract
7 for Soto Street, 26th Street and 50th Street improvement
8 pursuant to Contract No. 440 of the City of Vernon; and
9 WHEREAS, Arthur E. Nelson, Director of Community
10 Services, has reported to the City Council of the City of Vernon
11 under date of November 17, 1981, that said work has been
12 completed and recommended that the work be accepted and payment
13 be made to the Contractor in accordance with the Agreement.
14 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
15 THE CITY OF VERNON AS FOLLOWS:

SECTION 1: That the work for Soto Street, 26th Street
17 and 50th Street improvement, pursuant to Contract No. 440, is
18 hereby approved by the City of Vernon.

SECTION 2: That the total contract amount is Two Hundred
20 Twenty-Two Thousand Nine Hundred Forty-Seven Dollars and Sixty-
21 Eight Cents ($222,947.68). That there is now due to the
22 Contractor a final partial payment totaling Ninety-Five Thousand
23 Nine Hundred Fifty Dollars and Eight Cents ($95,950.08), which
24 should be paid at this time and the remaining ten percent (10%)
25 of the total contract amount or the sum of Twenty-Two Thousand
26 Two Hundred Ninety-Four Dollars and Seventy-Seven Cents
27 ($22,294.77) is payable thirty-five (35) days after the adoption
28 of this Resolution and the City Council of the City of Vernon
1 hereby directs payment of said sums as set forth to Excel
2 Paving Company and instructs the City Clerk to file a Notice of
3 Completion with the County Recorder.

SECTION 3: That the City Clerk of the City of Vernon
5 shall certify to the passage of this Resolution and thereupon
6 and thereafter the same shall be in full force and effect.
7 APPROVED AND ADOPTED this 17th day of November, 1981.
