Resolution No. 4909 1 2 3 4 5 6 RESOLUTION NO. 4909 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON AUTHORIZING THE EXECUTION OF AN EXAMINATION OF TRACT AND P'ARCEL MAPS AGREEMENT BETWEEN THE CITY OF VERNON AND THE COUNTY OF LOS ANGELES FOR A FIVE (5) YEAR PERIOD 7 WHEREAS, the Chief Administrative Officer of the 8 County of Los Angeles has presented an Examination of Tract and 9 Parcel Maps Agreement as authorized by Resolution No. 4883 10 adopted by the City Council of the City of Vernon on March 2, 11 1982; and 12 WHEREAS, the City Council of the City of Vernon desires 13 to enter into said Agreement for a five (5) year period, 14 commencing July 1, 1982 and terminating on June 30, 1987. 15 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF 16 THE CITY OF VERNON AS FOLLOWS: 17 SECTION 1: That the City Council of the City of Vernon 18 hereby finds and determines that the recitals contained 19 hereinabove are true and correct. 20 SECTION 2: That the Mayor and the City Clerk of the 21 City of Vernon are hereby authorized and directed to enter into 22 and execute the Examination of Tract and Parcel Maps Agreement 23 between the City of Vernon and the County of Los Angeles for 24 a five (5) year period, commencing July 1, 1982 and terminating 25 on June 30, 1987, a copy of said Agreement is attached hereto 26 as Exhibit "A" and incorporated herein as though fully set forth 27 a t length. 28 SECTION 3: That the City Clerk of the City of Vernon 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1 shall certify to the passage of this Resolution and thereupon 2 and thereafter the same shall be in full force and effect. 3 APPROVED AND ADOPTED this 18th day of May, 1982. ~.~ ). ~~..,r.: , "-~ - . ,~ONIS C. The Subdivision Map Act, at Section 66431 of the Government Code, provides that: "Upon mutual agreement of their respective legislative bodies, the county surveyor may perform any or all of the duties assigned to the city engineer, ", 16 including required certifications. Hnenever such duties have been divided between the county surveyor apd the 17 18 city engineer, each officer shall certify to the duties performed by him." B. The parties hereto desire that the County Engineer perform in accordance with the provisions of the Subdivision Map Act certain duties otherwise assigned to the City Engineer relating to the certification of tract maps and parcel maps of all subdivisions 26 proposed within t~e City~ THEREFORE, the parties agree as follows: 1. The City Engineer of the City shall examine each tract 27 map of each subdivision within the limits of the City, with respect 28 to its conformity with the tentative map or maps apd any approved EXHIBIT "A" . . 00, '.- " 7('~ -Cl O/i3)- !alterations thereof and with applicable City records and ordinances, , 2 I'and shall place on the face of such map his certificate in substan- 3 I t ially the following form: . 4 I HEREBY CERTIFY that I have examined this I 7 map and that it conforms substantially to the tentative map and all approved alterations thereof; that all provisions of subdivision ordinances of 5 6 8 the City applicable at the time of approval of the 9 tentative map have been complied with; and that I am satisfied that this map is technically correct with respect to City records. 10 11 12 (Da ted) ( Signed) ( City Engineer), 13 14 2. The County Engineer of Los Angeles County shall examine such 15 Itract maps with respect to all matters not included in the City 16 'Engineer's examination and shall so certify on the face of each map 17 lin substantially -the following form. In the instance of the County Engineer having been duly 20 appointed and authorized to act in the capacity of City Engineer, it 21 is agreed that he will complete and execute the foregoing certifi- 22 ca e or an appropriate combination thereof. Lacking such authoriza-' 23 ti n, only the certificates pertaining to State law and the 24 Su division Map Act will be completed, leaving the certificates 25 re ating to local ordinance and records to be completed by the duly 26 au horized City Engineer. 27 6. County Engineer shall collect such fees as are so provided 28 \ as County's sole comp~nsation for the service rendered hereunder. -3- # TS76T- PS 1:80 . . 1 For the purpose of effectuating collection of fees provided 2 for herein, it is agreed that the County Engineer I shall have all th1 responsible for 3 powers of the City Engineer or other City officer 4 the collection of such fees and that City shall supply full 5 cooperation therein. 6 7. The Assumption of Liability Agreement executed by the 7 parties to this agreement, and approved by the Board of Supervisors 8 on December 27, 1977 currently in effect is hereby made a part of I 9 and incorporated into this agreement as if set out in full herein 10 unless said Assumption of Liability Agreement is expressly 11 superseded by a subsequent agreement hereafter entered into 12 between the parties hereto. 13 8. This contract shall have an effective date of July I, 1982 14 and unless sooner terminated as provided for herein, this agree- 15 ment shall run for a period ending June 30, 1987 , and at the option 16 of the City Council of said City, with the consent of the Board of 17 Supervisors of said County, shall be renewable for additional 18 periods of not to exceed five (5) years each. 19 In the event the City desires to renew this agreement for 20 any succeeding five-year period, the City, not later than 21 December 31 next preceding the expiration date of this agreement, 22 shall notify the Board of Supervisors of County that it wishes to 23 renew the same, whereupon said Board of Supervisors, not later than 24 the last day of January, shall notify said City Council in writing 25 of its acceptance of such renewal for an additional five-year 26 period or such other term as mutually agreed upon, otherwise such 27 agreement shall finally terminate at the end of such five-year 28 period. -4- . . ,T576T- PS 1.80 ., , 1 Notwithstanding the provisions of this paragraph hereinabove I 2 I set forth, the County may terminate this agreement at any time by 3 giving thirty (30) days prior written notice to the City. The City 4 may terminate this agreement as of the first day of July of any 5 I year upon thirty (30) days prior'written notice to the County. 6 , I This contract shall be further terminated at any time Cityl 9. 7 fails to enact,and maintain in full force and effect an ordinance 8 providing for the payment by subdividers of fees which are in 9 the opinion of the County Auditor sufficient to pay the costs of 10 rendition of services by the County Engineer, as provided for 11 herein.
