RESOLUTION NO. 4923
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON ESTABLISHING DOG LICENSE FEES AND
APPROVING THE RENEWAL OF THE ANIMAL CONTROL
SERVICES CONTRACT WITH SOUTHEAST AREA ANIMAL
CONTROL AUTHORITY FOR AN ADDITIONAL YEAR,
JULY 1, 1982 TO JUNE 30, 1983, AND AUTHORIZING
THE EXECUTION OF AN AMENDMENT TO SAID AGREEMENT
7 WHEREAS, the City Council of the City of Vernon has
8 adopted an Ordinance providing for animal control regulation;
9 and
10 WHEREAS, Louis S. Hauger, Director of Environmental
11 Health, has recommended by memo dated June 30, 1982, that the
12 City of Vernon renew the Agreement with Southeast Area Animal
13 Control Authority for animal control services and that the
14 execution of an Amendment to said Agreement would be in the
15 best interests of the City of Vernon.
16 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
17 THE CITY OF VERNON AS FOLLOWS:

SECTION 1: That the City Council of the City of Vernon
19 does hereby find and determine that the recitals contained herein
20 above are true and correct.

SECTION 2: That the City Council of the City of Vernon
22 hereby approves the renewal of the Agreement with Southeast Area
23 Animal Control Authority for an additional year, July 1, 1982 to
24 June 30, 1983, and hereby approves the execution of an Amendment
25 to said Agreement which is attached hereto as Exhibit "A" and
26 incorporated herein as though fully set forth at length and
27 authorizes the Mayor and the City Clerk to execute said Amendment
28 to said Agreement for and on behalf of the City Council of the
1 City of Vernon.

SECTION 3: That the City Council of the City of Vernon
3 establishes fees for the licensing of dogs as follows:

SECTION 4: The City Clerk of the City of Vernon shall
7 certify to the passage of this Resolution and thereupon and there

AMENDMENT TO AGREEMENT
THIS AMENDMENT TO AGREEMENT is executed this
day of
1982 by and between the SOUTHEAST AREA ANIMAL CONTROL AUTHORITY
(herein "AUTHORITY"), and the CITY OF VERNON (herein "CITY").
RECITALS
A. AUTHORITY and CITY have heretofore entered into an Agreement
relative to the AUTHORITY's providing of animal control services for and on
behalf of the CITY.
B. AUTHORITY has performed animal control services for the CITY during
the fiscal years 1980-1981 and 1981-1982 and the CITY and AUTHORITY desire to
extend the Agreement in order to enable the AUTHORITY to continue to provide
animal control services to the CITY during the fiscal year 1982-83.
NOW THEREFORE, in consideration of performance by the parties of the
covenants and conditions herein contained, the parties agree as follows:
1. Section II..5. of said Agreement is amended to read as follows:
5. That it agrees to pay to AUTHORITY during the term of this
agreement that amount, based on an hourly rate of $23.00, pro rata, for each
service request or patrol as set forth in item 2(a) and 2(b) of this Agreement and
in the attached Exhibit "A", setting forth Shelter and medical fees and billed to
CITY each month, said sums to be paid within ten (10) days after the end of the
month within which the services are rendered. If payment is not delivered to the
AUTHORITY within ten (10) days after the month within which these services are
rendered, the AUTHORITY is entitled to recover interest thereon. Said interest
shall be at a rate of 1% per calendar month or any portion thereof calculated from
the last day of the month in which the services were performed. The
AUTHORITY may satisfy such indebtedness, including interest thereon, from any
funds of the CITY on deposit or to the credit of the AUTHORITY, without giving
further notice to CITY of the AUTHORITY's intent to do so.
2. Section III.9 of said Agreement is amended, and shall read:

That the term of this Agreement shall be for the period of July 1, 1982,
through June 30, 1983, inclusive, unless this Agreement is terminated as herein
provided, and said Agreement shall be extended on an annual basis thereafter,
unless ninety (90) days prior to the end of the fiscal year, June 30, notice is given
by either party of their intent to terminate this Agreement. Should AUTHORITY
default during the term of this Agreement in the performance of its obligations as
set forth herein and fail to cure said default within fifteen (15) days' written
notice to do so, then CITY may terminate this Agreement, and upon payment to
AUTHORITY of monies owing to the AUTHORITY for satisfactory performances
rendered pursuant to this Agreement and through the date of said termination,
t_hereafter there shall be no obligation of the CITY to the AUTHORITY. Should
CITY fail to pay the sums owing to the AUTHORITY as provided hereunder or
otherwise default in any provision of this Agreement, and fail to cure said default
within fifteen (15) day's written notice to do so then AUTHORITY may terminate
this Agreement and upon the effective date of said termination, there shall be no
further obligation of the AUTHORITY to the City.
3. Section 1.3 of said Agreement is amended by adding thereto section (a).
as follows:
(a). To inspect and canvass all properties within the CITY to
determine the location at which animals are present, but shall not be involved in
the actual issuance of licenses for any such animals. If CITY requests this
service, it agrees to give the AUTHORITY thirty (30) days written notice prior to
the start of the Fiscal Year in which the inspection and canvass is to be per-
formed. Fiscal Year shall be the period from July 1 through June 30. If CITY
requests this inspection and canvass, it further agrees to pay to the AUTHORITY
the amount that will be calculated and presented to the CITY fifteen (15) days
prior to the start of the Fiscal Year. This amount shall be'calculated by obtaining
CITY's representative percentage of population in relation to the total population
of all the cities in the AUTHORITY District that desire a canvass. The total cost
to the AUTHORITY to perform that service for those cities shall then be
multiplied by the CITY's representative percentage to obtain CITY's cost."
4. All other provisions of said Agreement, as amended, remain unchanged.

IN WITNESS WHEREOF, the CITY OF VERNON by order of its City Council,
caused this Amendment to Agreement to be signed by its Mayor and attested by
its Clerk, and the SOUTHEAST AREA ANIMAL CONTROL AUTHORITY, by order
of its Commission, has caused this Agreement to be subscribed by the Chairman of
said Commission and the seal of said Commission to be affixed thereto and
attested by the Clerk of said Commission.
