RESOLUTION NO. 4988
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON URGING CONGRESSMEN IN THE HOUSE OF
REPRESENTATIVES TO ElTHER DELAY OR DEFEAT THE
PASSAGE OF BILL H.R. 1341 WHICH ESTABLISHES
A NATIONAL MONUMENT AT MONO LAKE
6 WHEREAS, the City of Vernon owns water rights which have
7 been determined in accordance with the laws of the State of
8 California; and
9 WHEREAS, the City of Vernon is a member of the
10 Metropolitan Water District and is entitled to receive. water
11 service from said district; and
12 WHEREAS, the adoption of H.R. 1341 may ultimately
13 impact the water supplies available within the State of Cali...
14 fornia ; and
15 WHEREAS, the adoption of H.R. 1341 may impair the
16 effectiveness of California I s water rights statute by imposing
17 national legislation which may be in conflict with said water
18 rights statute; and
19 WHEREAS, the Supreme Court of California has recently
20 issued its decision in National Audubon Society,. et al., v.
21 The .Superior Court of. Alpine County, which addresses the
22 relationship between the public trust doctrine and the water
23 rights statute in the State of California; and
24 WHEREAS, said decision and the eventual determination
25 by the parties in said litigation is uncertain and, therefore,
26 the House of Representatives should delay or defeat Bill H.R.

NmV', THEREFORE ,BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
4 urges the Congressmen in the House of Representatives to
5 recognize the uniqueness of California's water rights statute
6 and delay or defeat the passage of Bill H. R. 1341 until the
7 decision of the California Supreme Court in National Audubon
8 Society, et aL, v. The Supreme Court of Alpine County (S.F.
9 24368) is more fully determined.

SECTION 2: The City Clerk is hereby directed to send
11 copies of this Resolution to Congressman Seiberling (D-Ohio),
12 Congres~man Lehman (D-California) and the Congressmen representing
13 the City of Vernon.

SECTION 3: The City Clerk of the City of Vernon shall
15 certify to the passage of this Resolution and thereupon and
16 thereafter the same shall be in full force and effect.
17 APPROVED AND ADOPTED this 5th day of April, 1983.
