RESOLUTION NO. 5007
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON ACCEPTING THE WORK OF EXCHANGE AVENUE
AND LOMA VISTA AVENUE, PAVING, STORM DRAIN AND
WATER LINE CONSTRUCTION IN ACCORDANCE WITH
CONTRACT NO. 455 OF THE CITY OF VERNON
6 WHEREAS, FLEMING ENGINEERING INC. was awarded the
7 contract for the 'work of Exchange Avenue and Loma Vista Avenue,
8 paving, storm drain and water line construction pursuant to
9 Contract No. 455 of the City of Vernon; and
10 WHEREAS, Arthur E. Nelson, Director of Community
11 Services, has reported to the City Council of the City of Vernon
12 on May 31, 1983, indicating that said work has been completed
13 and recommending that the work be accepted and payment be made
14 to the Contractor in accordance with the Agreement.
15 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
16 THE CITY OF VERNON AS FOLLOWS:

SECTION 1: That the work of Exchange Avenue and Loma
18 Vista Avenue, paving, storm drain and water line construction
19 pursuant to Contract No. 455 is hereby approved by the City of
20 Vernon.

SECTION 2: That the total contract amount, including
22 Extra Work Orders and Change Orders, is Three' Hundred Forty-Seven
23 Thousand One Hundred Ninety-Five Dollars and Seventy-Nine Cents
24 ($347,195.79). That there is now due to the Contractor a final
25 partial payment of One Hundred Seventy-Four Thousand Five
26 Hundred Twenty-Seven Dollars and Sixty-Three Cents ($174,527.63),
27 which should be paid at this time and the remaining ten percent
28 (10%) of the total contract amount or the sum of Thirty-Four
1 Thousand Seven Hundred Nineteen Dollars and Sixty Cents
2 ($34,719.60) is payable thirty-five (35) days after the adoption
3 of this Resolution and the City Council of the City of Vernon
4 hereby directs payment of said sums as set forth to FLEMING
5 ENGINEERING INC. and instructs the City Clerk to file a Notice
6 of Completion with the County Recorder.

SECTION 3: That the City Clerk of the City of Vernon
8 shall certify to the passage of this Resolution and thereupon
9 and thereafter the same shall be in full force and effect.
10 APPROVED AND ADOPTED this 7th day of June, 1983.
