RESOLUTION NO. 5014
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON REQUESTING MEMBERSHIP IN THE INDEPENDENT
CITIES RISK MANAGEMENT AUTHORITY; RATIFYING AN
AGREEMENT WITH CERTAIN OTHER CITIES ENTITLED
"JOINT EXERCISE OF POWERS AGREEMENT FOR INSURANCE
AND RISK MANAGEMENT PURPOSES"; RATIFYING THE BY-
LAWS FOR THE PROPERTY RISK MANAGEMENT COMMITTEE
AND WORKERS' COMPENSATION RISK MANAGEMENT COMMITTEE
8 WHEREAS, Sections 990 and 6500 of the Government Code
9 of the State of California authorize municipalities to jointly
10 exercise the power to manage their conunon risks; and
11 WHEREAS, several cities have entered into a Joint Exercis
12 of Powers Agreement For Insurance and Risk Management Purposes
13 dated January 1, 1980; and
14 WHEREAS, said Agreement provides for the creation of
15 the Independent Cities Risk Management Authority; and
16 WHEREAS, said Agreement permits additional cities to
17 become members; and
18 WHEREAS, the City Council of the City of Vernon supports
19 the purposes of the Independent Cities Risk Management Authority;
20 and
21 tVREREAS, the City Council of the City of Vernon pursuant
22 to Article XIV of said Agreement intends to request membership
23 in the Independent Cities Risk Management Authority; and
24 WHEREAS, the City Council of the City of Vernon would
25 agree to be bound by the provisions of the Joint Exercise of
26 Powers Agreement for Insurance and Risk Management Purposes dated
27 January 1, 1980, and the By-Laws for the Property Risk Management
28 Committee and for the Workers' Compensation Risk Management
of
1 Committee as a condition of said membership; and
2 WHEREAS, the City of Vernon is desirous of having
3 representation upon the Governing Board of the Independent Cities
4 Risk Management Authority and the Property Risk Management
5 Committee and the Workers' Compensation Risk Management Conunittee.
6 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
7 THE CITY OF VERNON AS FOLLOWS:

SECTION 1: That the City Council of. the City of Vernon
9 hereby finds and determines that the recitals contained herein-
10 above are true and correct.

SECTION 2: That the City Council of the City of Vernon
12 hereby requests membership in the Independent Cities Risk
13 Management Authority.

SECTION 3: That the City Council of the City of Vernon
15 hereby approves and agrees to be bound by the provisions of the
16 Joint Exercise of Powers Agreement For Insurance and Risk
17 Management Purposes dated January 1" 1980, which created the
18 Independent Cities Risk Management Authority, a copy of which has
19 been presented to the City Council concurrently' with this
20 Resolution and the City Council hereby orders said Agreement to
21 be received and filed by the City Clerk.

SECTION 4: That the City Council of the City of Vernon
23 hereby approves and agrees to be bound by the provisions of the
24 By-Laws for the Property Risk Management Committee and the
25 Workers' Compensation Risk Management Committee, copies of which
26 have been presented to the City Council concurrently with this
27 Resolution and the City Council hereby orders said By-Laws to
28 be received and filed by the City Clerk.

SECTION 5: The City Council of the City of Vernon will
2 appoint by minute order a City Councilman to represent the City
3 of Vernon on the governing board of the Independent Cities Risk
4 Management Authority and will also appoint an alternate.

SECTION 6: That the City of Vernon by ratifying the
6 Agreement joins other cities in accepting the property and
7 workers' compensation insurance quotations of the brokerage firm
8 of Marsh & McLennan, Inc.

SECTION 7: In accordance with Article XIII of the
Agreement, notices shall be delivered to the person specified
below:

SECTION 8: That the City Council of the City of Vernon
15 does hereby authorize the Mayor and the City Clerk to execute,
16 if necessary, a counterpart of the Joint Exercise of Powers
17 Agreement For Insurance and Risk Management Purposes of the
18 Independent Cities Risk Management Authority dated January 1,
19 1980.

SECTION 9: That the City Clerk is hereby authorized
21 to deliver said counterparts, fully executed, if necessary, and
22 a copy of this Resolution to the Independent Cities Risk
23 Management Authority for, and on behalf of, the City Council of
24 the City of Vernon.

SECTION 10: The City Clerk of the City of Vernon shall
certify to the passage of this Resolution and thereupon and
thereafter the same shall be in full force and effect.
