RESOLUTION NO. 5019
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON ESTABLISHING COMPENSATION FOR THE
CITY ATTORNEY, DAVID B. BREARLEY, IN ACCORDANCE
WITH THAT CERTAIN A}ffiNDMENT TO THE CITY
ATTORNEY EMPLOYMENT AGREEMENT APPROVED BY
RESOLUTION NO. 4774
WHEREAS, the Amendment to the City Attorney Employment
Agreement was approved and adopted by Resolution No. 4774 on
February 17, 1981; and
WHEREAS, said Amendment provided, in part, as follows:
". . .in the event across the board increases
in salary are provided for miscellaneous
employees, the percentage rates of said
increase granted to said employees shall be
applied to the retainer salary and hourly
rate provided for. . .and said increases
shall be effective the same date as the
across the board increases are effective
for said employees of said City."
and
WHEREAS, the City Council of the City of Vernon on
June 30, 1983 approved and adopted Resolution No. 5018 providing
for across the board increases for miscellaneous employees to be
effective July 1, 1983, with a percentage increase of six percent
(6%); and
WHEREAS, pursuant to said Amendment the City intends
to increase the compensation for the City Attorney six percent
(6%).
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: That the City Council of the City of Vernon
28 does hereby find and determine that the recitals contained

1 hereinabove are true and correct.

SECTION 2: That the City Council of the City of Vernon
3 hereby establishes compensation for David B. Brearley, City
4 Attorney, for city attorney'services, a retainer salary of Three
5 Thousand Six Hundred Fifty-Seven Dollars ($3,657.00) per month,
6 and agrees ,to pay to David B. Brearley in full payment for
7 services rendered in excess of forty-five (45) hours per month
8 a fee for legal services of One Hundred Seventeen Dollars and
9 Fifty-Three Cents ($117.53) per hour for every hour of legal
10 services provided in each month in excess of said forty-five
11 (45) hours.

SECTION 3: That in all other respects except as herein-
13 above provided, the terms and conditions of the City Attorney
14 Employment Agreement dated June 29, 1979, as amended February 25,
15 1981, shall remain in full force and effect.

SECTION 4: That the City Clerk of the City of Vernon
17 shall certify to the passage of this Resolution and thereupon
18 and thereafter the same shall be in full force and effect.
19 APPROVED AND ADOPTED this 30th day of June, 1983.
