RESOLUTION NO. 5030
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON APPROVING AND AUTHORIZING THE EXECUTION
OF AN AGREEMENT BY AND BETWEEN THE CITY OF VERNON
AND LAKEWOOD PIPE SERVICE, INC. FOR THE
FABRICATION OF EXHAUST ELBOWS FOR THE VERNON
DIESEL GENERATING PLANT
7 WHEREAS, the City of Vernon desires the fabrication of
8 exhaust elbows for the Vernon Diesel Generating Plant located
9 at 2715 East 50th Street, Vernon, California; and
10 WHEREAS, Lewis R. Adams, Operations Manager of the
11 Light and Power Department, has recommended that the bid of
12 Lakewood Pipe Service, Inc. be accepted; and
13 WHEREAS, the City Council of the City of Vernon has
14 determined that it is in the best interests of the City of Vernon
15 to enter into an agreement with Lakewood Pipe Service, Inc. as
16 set forth above.
17 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
18 THE CITY OF VERNON AS FOLLOWS:

SECTION 1: That the City Council of the City of Vernon
20 hereby determines that the recitals contained hereinabove are
21 true and correct.

SECTION 2: That the City Council of the City of Vernon
23 hereby approves the Agreement, a copy of which has been presented
24 to the City Council concurrently with this Resolution, and the
25 City Council hereby orders said Agreement to be received and
26 filed by the City Clerk.

SECTION 3: That the City Council of the City of Vernon
28 hereby authorizes the Mayor and the City Clerk to execute said
1 Agreement for, and on behalf of, the City of Vernon.

SECTION 4: That the City Clerk of the City of Vernon
shall certify to the passage of this Resolution and thereupon
and thereafter the same shall be in full force and effect.
APPROVED AND ADOPTED this 2nd day of August, 1983.

3 THIS AGREEMENT is made and entered into as of this

5 BY AND BETWEEN CITY OF VERNON, a Municipal
6 Corporation (hereinafter
the "City")
7 AND LAKEWOOD PIPE SERVICE, INC.
8 (hereinafter "Lakewood Pipe")

10 RECITALS

12 WHEREAS, the City desires the fabrication of exhaust
13 elbows for the Vernon Diesel Generating Plant located at 2715
14 East 50th Street, Vernon, California;-and
15 WHEREAS, Lakewood Pipe has submitted the lowest bid
16 to perform said work.
17 NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS,
1g PROMISES AND CONDITIONS HEREINAFTER SET FORTH, THE PARTIES HERETO
19 :AGREE AS FOLLOWS:
20 SECTION. T: Scope of Work.
21 Lakewood Pipe will .furnish all labor, equipment and
22 materials and-will perform all work necessary. in order to
23 fabricate the exhaust elbows for-the Vernon Diesel Generating
`24 Plant as more particularly described in the attached Exhibit."A"
25 which is hereby incorporated herein by this reference..
26 SECTION 2: Consideration.
27 City shall. pay Lakewood Pipe the sum of $1,950.00 per
2g elbow for a total of $19,500.00; the sum set forth in the bid of
1 Lakewood Pipe which is attached hereto and hereby incorporated
2 by this reference for the performance of the work described
3 herein.
4 IN WITNESS WHEREOF the parties hereto have executed
5 this. Agreement or caused it to be executed as of the day, month
6 and year first above written.
