Resolution No. 5051 1 2 3 4 5 RESOLUTION NO. 5051 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON FIXING SURCHARGE RATES TO BE CHAF,GED FOR ELECTRICAL ENERGY DISTRIBUTED AND SUPPLIED BY SAID CITY WITHIN ITS BOUNDARIES IN ACCORDANCE WITH ORDINANCE NO. 929 6 WHEREAS, the Federal Energy Regulatory Commission 7 (hereinafter "FERC") in Docket No. ER82-427 permitted Southern 8 California Edison Company to institute new electrical rates 9 applicable to resale purchases effective June 2, 1982; and 10 WHEREAS, said rates were divided into two catego~ies 11 and delineated Step 1 and Step 2 rates with Step 1 rates being 12 effective June 2, 1982 and Step 2 being effective upon commercial 13 operation of San Onofre Nuclear Generating Unit No.2; and 14 WHEREAS, said rates were permitted to become effective 15 subject to refunds in the event the FERC finds said rates to be 16 unreasonable at the conclusion of its consideration of said 17 docket; and 18 WHEREAS, the City of Vernon has intervened in said 19 docket questioning the reasonableness of Southern California 20 Edison Company's wholesale rates; and 21 WHEREAS, the City of Vernon has been currently purchasing 22 electrical energy for resale under a time-of-use rate schedule 23 permitted by the FERC in Docket No. ER82-427 which includes all 24 of the rates delineated as Step 1 rates; and 25 WHEREAS, Baker G. Clay & Associaties, Inc. has prepared 26 a report on rate design containing their recommendations on new 27 rates including a surcharge rate for Step 2 which would be adopted 28 by resolution and submitted said report to the City Council during 1 a public hearing held on July 13, 1982; and 2 WHEREAS, said report recommended that rates go into 3 effect on September 1, 1982, that would recover the cost 4 associated with the Step 1 increases provided for in FERC Docket 5 No. ER82-427 and recommended specific surcharges to go into 6 effect when Southern California Edison Company is permitted to 7 institute Step 2 rates in coordination with the commercial 8 operation of San Onofre Nuclear Generating Station Unit No.2; 9 and 10 WHEREAS, the City Council of the City of Vernon held a 11 public hearing on July 13, 1982, to consider the recommendations 12 of Baker G. Clay & Associaties, Inc. and the adoption of 13 Ordinance No. 929; and 14 WHEREAS, the City Council adopted Ordinance No. 929 15 by giving it a first reading on July 22, 1982, and a second 16 reading on July 28, 1982, and it was effective September 1, 17 1982; and 18 WHEREAS, Section 4 of said Ordinance provided that the 19 City Council of the City of Vernon was authorized to adopt a 20 resolution to provide for a surcharge to the rates provided for 21 therein to recover the costs associated with a Step 2 rate 22 increase authorized by the FERC on Docket No. ER82-427. 23 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL 24 OF THE CITY OF VERNON AS FOLLOWS: 25 SECTION 1: The City Council of the City of Vernon hereby 26 finds and determines that the recitals contained hereinabove are 27 true and correct. 28 SECTION 2: In accordance with Section 4 of Ordinance No. -2- 1 929, the City Council hereby adopts rates, which include 2 surcharge rates, set forth in the attached exhibits referenced 3 and identified below, are hereby incorporated by reference and 4 made a part hereof as though fully set forth at length and are 5 hereby adopted as the City's rates for the distribution of the 6 electrical energy supplied by the City for certain classes of 7 service to be effective October 9, 1983. 8 SCHEDULE NO. 9 VERNON A-8 10 VERNON A- 7 11 VERNON GS~2 12 VERNON GS-l 13 VERNON D 14 VERNON PA-l 15 16 VERNON 'PA-2 17 18 VERNON TC-l 19 General Service SHEET NO. Excess transformer capacity shall be billed at $1.00 per kVA per month. 12. Contract Demand : A contract demand will be established by the Company, based on applicant's demand requirements for any customer newly req4esting service on this schedule and for any customer of record on this schedule who requests an increaSe or decrease in transformer capacity in accordance with Rule No.. 12D. A contract demand arrangement is available upon request for all customers of record on this schedule. Contract demand is based l.lpon the nominal kilovolt-ampere rating of the Company's serving transformer(s) or the standard transformer size determined by the Company as required to serve the customer's stated meas.urable kilowatt demand, whichever is less and is expressed in kilowatts. 13. Minimum Demand Charge: Where no contract demand is involved, the monthly minimum demand charge shall be computed by multipl ying the btll1ng demand by the demand charge per kilowatt. Voltage Discount: '!he charges before adjustments will be reduced by 3% for service delivered and metered at voltages of from 2 kV to 10 kV; and by 5% for service delivered and metered at voltages over 50 kV; except that when only one transformation from a transmission voltage level is involved, a customer normally entitled to a 3% discount will be enti tled to a 4% discount. Power Factor Adjustment: The charges will be adjustede~ch month for the power factor as follows: The charges will be decreased by 20 cents per kilowatt of measured maximum demand and will be increased by 20 cents per kilovar of reactive demand. However, in no case shall the kilovars used for the adjustroentbe less than one-fifth the number of kilowatts. The kilovars of reactive demand shall be calculated by multiplying the kilowatts of measured maximum demand by the ratio of the kilovar-hours to the kilowatt hours. Demands in kilowatts and kilovars shall be determined to the nearest unit. A rachet device will be installed on the kiloVar-hour meter to prevent its reverse operation on leading power factors. 6. Temporary Discontinuance of Service: Where the use of energy is seasonable or. intermittent, no adjustments will be made for a temporary discontinuance of service. Any customer prior to resuming service within twelve (12) months after such service was discontinued will be required .to pay all charges which would have been billed if service had not been. discontinued. 7. Adjustment for Off-Peak Demand: Upon application by the customer, in any month where the maximum demand exceeds 500 KW, any kilowatts of maximum demand in excess of the on-peak d.emand will not be considered in establishing the billing demand for computing the energy charge, but will be considered in establishing the billing demand for computing the demand charge,. by adding one-half of the amount tha t the maximum demand exceeds tl1e on-peak demand, to the on-peak demand. The on-Peak demand '1ill be the maximum dem.and occurring between the hours of 6: 30 a .m. and 10: 30 p.m., Pa.cific Standard Time, of any day except Sundays and the following holidays: New Years, Washington's Birthday, Memorial Day, Independence Day, Labot Day, Thanksgiving Day, and Christmas. 8. Connected Load: Connected load is the sum of the rated capacities of all of the customer's equipment that it is possible to connect to the Company's lines at the same time, determined to the nearest 1/10 hp. In no case will charges be based on less than 2 hp for single-phase service or no less than 3 hp for three-phase service. The rated capacity of the customer's equipment will be the rated horsepower output of standard rated motors, the rated horsepower of welders detennined in accordance with the section designated Welder Service in Rule No.2, and the rated kilovolt-ampere input capacity of other equipment, with each kilovolt-ampere of input considered equal to one horsepower. Normally such ratings will be based on the manufacturer's rating as shown on the nameplate or elsewhere but may, at the option of the Company, be based on tests or other reI iable information.
